Annexation Test For Commissioner Horgan

Robert Horgan voted decidedly anti-annexation regarding a landowners attempt to annex a 16-acre tract on Trickum Creek Road into Tyrone. Horgan to this point, has been a slow growth advocate.

Of course the only commissioner in favor of the annexation was Herb Frady. He probably woke up just in time to cast his vote.

Commissioner Horgan has been a go-with-the-flow member so far.

Do you think the attitudes toward growth will change with the addition of Maxwell and Smith? Or will Commissioner Frady still be the only guy on the Board pushing higher density development?

don't have jacks*** to do with cities annexing and zoning. And SpearRoadDude, you should know this.

Recall that Dunn/Wells/Pfeifer blew many thousands of taxpayer dollars suing cities in opposition to annexation issues, and lost every time because they had no "standing" in the issues. Courts throw those silly suits out repeatedly.

I know of only one zoning that Horgan voted on, the Cathy property on Redwine Road, and there was probably no choice there. The BOC has frequently given "lot size averaging" consideration to zoning requests, and that's what they did on the Cathy property. To have done otherwise would have certainly been an invitation for a lawsuit.

You can't practice "lot size averaging" selectively, once you do it you set a irreversible precedent. That precedent was set years ago.

What this BOC needs to do is get on the ball and start improving infrastructure to accomodate the growth the cities are fostering. It's that simple.

Wow tonto707, you're quite belligerent today. That blog bully muscle flexing with the "jacks***" really makes us all pay attention to what you have to say.

With annexation, there's a process that is followed if the county poses an objection. No, the county commission can't vote an annexation up or down on the spot. Now I'm going to have to look up the code section, there goes my waxing the car this evening for sure!

Why was the County voting on this issue?

The towns vote annexation, not the county, unless there is some special case issue here.

Sorry, just not up to speed on this issue.

As I understand it from a previous article in the Citizen a month ago, all requests for annexation have to go before the county. I believe the county can raise objections to a request causing some other kind of process - I have few details of that process - to go into effect.

There's also an article currently on the web site about Coweta fighting an annexation in Sharpsburg. That particular annexation is a Pathway special containing nearly 500-acres.

You are correct that annexation requests must go before the county. By opposing an annexation request, the county can slow the process somewhat, but ultimately, the towns/cities are permitted by state law to annex with or without the approval of the county. Kind of makes you wonder "What's the point?"

Yes, the County is allowed to send an oppostion paper to the State.

But, as you say, without some really overriding cause the annexation goes through.

The original wording made it sound like the County was voting on approval. Sorry.
