Coach seeking student's nude pic gets $100K bond

Heintz has resigned from his position at Whitewater High School

A Whitewater High School assistant football coach arrested for one felony count of sexual exploitation of a minor, has been granted a $100,000 bond by a Fayette County Superior Court Judge.

The investigation into Coach Harry Heintz began with an allegation that he sent a text message to a student at the school, asking the student to send him a nude photo, sheriff's officials said Thursday morning.

Heintz, who taught 10th grade World History and also a weightlifting class, had the student's cellphone number in his possession, police said.

He was not immediately arrested because "the complaint is seemingly a school misconduct issue," sheriff's officials said late Thursday morning.
Heintz resigned Tuesday citing personal reasons, said school spokesperson Melinda Berry-Driesbach.

A letter notifying parents of the resignation was sent home, but the letter did not mention the allegations police have been investigating Heintz for, she said.

Meanwhile, the sheriff's investigation "will endeavor to make sure that this behavior did not transpire with other students," officials said.

Heintz is married to a teacher at Booth Middle School and formerly served in the Army in Iraq, according to information on the school's website.

A long-term substitute teacher has been named to take over Heintz’s teaching responsibilities and the school board is seeking resumes for the permanent position, Berry-Driesbach said. The substitute has a bachelor of arts degree in history and also has passed the Georgia teacher’s exam known as Praxis, she added.

As usual, some of the resident knee-jerkers among the Citizen's verbose commentators rushed to judgement without the facts. Now that we have the facts and it's been revealed that this case was nothing more than comments taken out of context (such a refined art among some here they should have PhD's in the matter) I wonder if people will take responsibility for their comments and make their contritions as public as their condemnations. The charges have been dismissed outright and the DA admits there were gross inaccuracies about the alleged text messages. Poor judgement is all either side is guilty of at this point.

I was not one of the people who previously posted about Coach Heintz. In fact, I hoped that the allegations against him weren't true. I saw the report that Channel 2 did last night about the charges being dropped; and while it appears that his comments were taken out of context, Coach Heintz also appears to have shown poor judgement in asking this girl to send him a picture to put on his phone along with her number, as well as some of the language that he used in conjunction with his request. From what I understood from last night's story, Coach Heintz was mentoring this girl, which is commendable. But I'm not sure why she would be calling him often enough for him to need her picture on his phone.
So I am glad that the charges against him were dropped, and I hope that both he and his wife can get some semblance of normality back into their life.

For all you that think stillions should be fired, get to know him first. What do you know about running a school or the pressures involved? I'm not in his office every day, but i would say i know him well enough to repudiate any thoughts of him being fired. He's a great principal. He may not be perfect, but he certainly doesn't need to be fired.

Look. everyone knows fayette county didn't buy their team. Being a whitewater student i hate to say it, but they're really good this year. obviously they're the best in the county. and if there was a school in fayette that would buy their team, fchs wouldn't be it. don't take things too seriously.

He was on nice person. Once after football practice during 10th grade (now a senior) he gave me a rides to my mom's job when no one else would take me. We talked about lots of stuff like music, sports and games. Id never figure he would do such a thing. Many people do things behind closed doors though. I remeber hearing this on the radio and i thought the news was incorrect because are school is like "nice" compared to schools were i live.

Why exactly are the citizens of Fayette County paying for you to attend Whitewater if you live in Riverdale, just because your cousin works at Whitewater? Unless you are living with your cousin (and supported by your cousin as well), you are just freeloading off of the taxpaying citizens of Fayette County. I can understand you wanting to attend a better school, but if you don't live here and pay taxes here, you don't belong in our schools.

I'm not afraid to tell you that your statement about the FCHS Tigers being "bought and paid for" is totally incorrect. Think about this: if this team was "purchased" then why have they had such lousy records for the past five +/- years?

YOU need to look at a series of pictures beginning with the 2002-03 Fayette Middle School (7th & 8th grade) teams, and continuing with the following year's 9th, JV, and varsity teams. You will see an overwhelming majority of the same faces in the middle school pix as you will see now in the high school's varsity pix.

We have been very actively involved in supporting and fundraising for the middle and high school football teams in the booster clubs. Nothing can be farther from the truth to say any of these teams was "purchased." Our football booster clubs continually bring in the lowest amounts of fundraising dollars than any other school in the county.

Quit being bitter about our football team's success. It is long overdue. I'm sure whichever team you support will have a very successful year, too, before long.

What does that mean?? If it implies what I think you mean......you are DEAD WRONG. The FCHS football team is the same team that played together at FMS and played together in Blue Devils. Your assumption that these players haven't BEEN Fayette County students from elementary thru high school is bogis. I challange you to prove it. I personally have watched this kids play football together from rec...middle school...to high school and they aren't from anywhere other then FAYETTE COUNTY. They have a great season thus far and they deserve it. Good players make a good season!! They are hometown boys, just like the boys at WHS, SMHS, MHS & SCHS. Don't dicredit their winning season, with a BS statement such as that. I encourage ALL FC fans to cheer for ALL of our hometown teams and players.

Last year, didn't the BOE explain to the citizens of Fayette County that they had cracked down on this nonsense? Just how difficult is it to ID individuals who do not live in Fayette County??? Guess it is just easier for the administrators to turn their backs -- and let the taxpayers continue to pay!! Pretty sad state of affairs!!

If he was white he couldn't do that. Blacks get in then threaten to sue if you take them out and the NAACP pays for the legal. It is sad but true. Last year they threw only one person out, they were white. They caught several blacks and that stayed. this coach is responsible for at least one of them staying for a year or two.

Coaches that attempt to molest your young girls, (and the plethera of the excuse making 'blame the minor' crowd)video cheating, "The only real cat" arrogance, multiple weapons, constant flow of out of district students, national exposure for drugs, inept administrators, drinking on field trips, and student/athletes from out of district harbored by rec. league coaches are all just a part of what the knock has been on WHS for the last few years. Stop living in denial WHS parents and students and fix the problem. This isn't about one school against another - this is about RIGHT and WRONG and who is living and leading and modeling both to the kids in this community!

If I were you WHS parents (or those being pulled from Peeples and the Whitewater CC area whose kids WILL be WHS students in the future), and I had a child at WHS, I would take control of the school before your child is one of those ten in some pedophiles cell phone or is led further astray by a drunk administrator who turns a blind eye to inappropriate activity, the out of district kids, or your cheer leader coaches who show up at regional competitions with gold halter tops on (that looked bra-less in the pics) looking like hookers (albeit inexpensive ones) but then again - that's the 'unconventional', 'out of the box', 'innovative' former Mt. Zion, and McIntosh reject Stillions version of 'leading' (of course, when you have as many skeletons in the closet as they all do at WHS - what choice do you have?).

On a similar note: Congrats to FCHS for pulling themselves up with in town players, sober administrators and high standards. It is good to see a team win with their own kids and see that they place academics and character above athletics despite having an unbeaten season- way to go FCHS 'REAL' Cats. Dr. Warr - thanks.

While I have you, as for the article on the 'Myspace accounts", it was dead on accurate. If you think the glorification of this thug music your brats are spending money has no consequences- look again. Again the excuse makers point out the gun is a 'fake' (as if that matters) well Professor Einstein - the gun may be fake but the mindset is just as perverted and the 'Mens Rea' is exactly the same. If you point one of those at a cop (or me, a bank teller, etc.) it might as well be real.

Fayette County and PTC children are simply a mirror of the increasingly clueless (anything goes, everything is okay, not my child, we talk about everything,etc.) mindset of the community. Failure to take responsibility for these children or one's own actions ( i.e., role models like Harry Heintz, Mary Ann Pena, Greg Stillions, Cashflo Dollar, etc., etc.), a lack of moral leadership for these kids, inept parenting, decaying family units, too much free time, lack of willingness to sacrifice or delay gratification, too little support for law enforcement, diminished school discipline, widespread attacks on institutions such as the military, the Presidency, and the cancer of codependency combined with the conscious and subconscious enabling have your community (and my property values) on a decline of astronomical proportions.

For God's sake - you can't even agree that kids who are approached for sex by a teacher are victims. Get it together Fayetteville - before it's too late.

I'm sure, by now, that everyone is aware that the inappropriate behaviors of the coach were reported to Ms. Pina last winter. The question is: Why wasn’t anything done at that time? Does anyone have any information regarding this? I find myself becoming increasingly angry the more I think of it. I’ve also heard that the coach was not a certified teacher. He needs to answer all of your questions. If he doesn't, call 770-460-3535 and ask for John DeCotis. If that doesn't work - call your board member and Kathy Cox or Stuart Bennett (both from Fayetteville) at the State Department of Education at 404-656-2800. If you are not willing to do that - watch the community crumble and know you were partially responsible.

Glad to hear that the Tigers are doing so well. That is a welcome lift for the old crowd. Sorry about all the bad press for the schools lately there. No one holds the schools in a bad light when it is just the kids who screw up - they are supposed to...well, sort of. It's when the ADULTS in charge are the heart of the story that there is NO EXCUSE!

Keep fighting the good fight. I hope you have all read Clarance Thomas' book - Hack needs to read it the MOST! I bet JeffC has read it... he's too smart to be a liberal anyway.

I am a student at whitewater high school. I knew coach heintz myself. He was my coach for summer workouts all summer. Our school was hit by this incident very fast and took care of it very quickly. Even though this happened to our school, we will still continue to show pride and joy in being a wildcat. Being a whitewater wildcat is important and will stay that way. Whitewater does not need to put up with all this crap anymore. There was a problem and it is gone now. This problem did not put shame on our school, it puts shame on the person who did the problem. Wildcats should stay proud of their school. And continue to cheer on their school with pride and joy in the Whitewater Wildcats.

We have only had one incident here at SMHS ever since we opened our doors 10 years ago! You guys have only been opened 5 years! After the game two weeks ago, when you guys held up that banner saying that we buy our players, I dont feel so bad. As a senior at Starr's Mill now, I remember ever since your guys school opened, you started a rivalvry
with us thinking you were better. We used to just have a rivalvry with McIntosh. After the soccer stunt you pulled last year too, i think you all deserve to be the highlight of FCBOE twice a year. Coach Heintz will not be the last person to ever let you down. You just continue brushing the bad guys off to the side and keep on doing the right things in life. There is no reason for for this incident to rob you kids of the joys of high school. Live large, be safe, and stay away from the debris that can haunt your life in the future.

So all of these people think coach is so bad. This teacher that i knew was the best he made world history fun, exciting, worth learning about. This man that I knew was funny and nice person. But these
girl(s) on the other hand you meantioned their name at school and you say "slut" or other names.The girl(s) 16 17 years old they should know what right and wrong and they were always in the wrong. the ARE NOT VICTUMS they were thinking oh another guy to be with. Coach always said he loves his wife very much. He IS a great man and an awesome teacher. He would turn football players into men. If thery did something wrong at school like talk back to a teacher, Coach would be on their case saying ah why did you do that they would run for it around the track. Coach was a hard working man and teacher and Coach. Why do these girls get called victiums. I believe they are CRIMIALS!!

I know this teacher is innocent untill proven guilty, but you are young and you don't know if they did not have proof they would not have arrested him.

So what if he is a coach, who cares?????????????????? Theses girls are kids, how old is he? He loves his wife, hummmm, explain that one when you have cell phone numbers of teenage girls and you text you want a nude photo.

I am sorry he let you down, but that is probably what it is. He just thought that he would not be found out.

I ask you how much do you think his wife feels loved now?

This incident is truly a tragedy in every way possible. For a start, Coach Heintz's life is completely ruined, regardless of the outcome of the investigation. Some would argue that it is rightly so, but I think we have all forgotten that he is merely charged with a crime, not convicted. I won't pass judgment on what actually took place; that is for an organized court of law, not an angry mob crying for blood. Second, if the allegations are true, the girls have surely suffered some sort of psychological trauma on account of this incident. Every crime has its victim(s). Third, it helps no one that the district attorney strongly desires to be reelected and to make a name for himself. He seems to cherry-pick the most lurid cases to trot out in front of the cameras. Also, the media always loves a story that keeps people watching, so they're playing this up as much as they can. The worst part about all of this is the opinions I see so often posted here. I have to ask, how can people with such prosperity pour out such hate? Especially at each other? Where do you get all of this anger from? I just wish that for once, we could all just step back and let the law take its proper course. I doubt that the courts need our guidance on how to handle their own matters. And for my last two cents, as a high school student, let me just say that I think that there is more at play than any of us can know. Something smells at Whitewater High, and it reeks of intrigue.

Alright I have never posted before so here it goes.

First I will address the specific issue at hand.

I know Harry and some of the girls involved and I do not approve of anything Harry did that crossed the line. I think no contact was ever made as most girls 16-18 think of an older man and YUCK! I am no Fabio but I would bet that is the reaction of MOST 16-18 year old girls. Harry showed poor judgment and WILL pay the price.

Now this has nothing to do with the specific case.

I wish all of us would get off the pulpit and Judicial bench and let the system work. It really bothers me that several people are accusing the YOUNG GIRLS of causing this to happen. This reaction is why MANY cases of abuse to rape go unreported. Please remember when young CHILDREN are involved often it is with an older person in an authority position and feel compelled to give them what is requested. (email address, cell phone number, myspace password and more)

Finally back to the issue.
These girls identies are known to many and they have to fsce their peers and adults whispers as they walk by.

Maybe this teacher is at fault, BUT, if teenagers become "adults" at 18, shouldn't they know what they are doing??? I mean, if this girl was a teenager, she should know the difference between right and wrong. So, basically, the people who say the WHOLE thing is Coach Heintz's fault are saying that the girl was just a victim? Okay, well, if that's the case, then I think I'll just go buy some alcohol even though I'm underage. It'll be the bartender's fault, right? He should have asked for ID? Yes. That's what you're saying. It's completely the bartender's fault for supplying the alcohol, and not mine for knowingly doing something wrong?

Sounds to me like that's a little unfair. He recieves some of the blame, but the girl shouldn't have been provoking him. COME ON. I will continue to believe that Whitewater is a great school. This should not reflect on the rest of the faculty there. No school is perfect. No person is. One teacher messed up. Let's move on, shall we?

Hello, I just want to go on record here and say I belive this man is innocent. {{{{{NAME EDITED OUT}}}}}I attend Whitewater High. I personally did not know this coach very well, but I do know some of his peers very well and I have great respect for him. I will not belive this man guilty of this crime until i have seen proof personally. People have a way of crucifying someone based on "allegations" that often do not turn out to be true events. The lacrosse players of Duke learned that one the hard way. I would encourage everyone here to try to seek out some facts and not take the fact that he was accused of a crime to mean he is guilty of a crime. Innocent until PROVEN guilty is a hallmark of our legal system since it was created. Please treat him with that respect. I will attempt to illustrate now why I have such respect for this man. The article says he served in the US Army in Iraq. What it fails to mention is he was a member of the Armys elite Delta Force. For those unfamilar with the military the Army's Delta Force, the Marines Force Recon, and the Navy's SEALS are all special forces, the best of the best of the best. These are the men who spend weeks behind enemy lines fighting with no food and little ammuntion, and who are forced to make decisions on a daily basis that would break any normal person. These are the men who perform the so called "black-ops", men who sometimes have their very existance denied by the country they labour to protect. These are the men who give there hearts and souls to be sacrificed so that poeple like you dont have to go to sleep worrying that tommorrow may be the last day you live. These are men who must kill their enemies without mercy or regret, take life without hesitation. Men like this have something called honor, and it leads them in every decsion they make, and asking a teenage girl to send a naked picture of herself is most definatly not honorable, and I do not belive Heintz would do it. I have seen nothing but honorable behaviour from this man and I will stand by him. If it turns out that he is guilty, and I have seen what I belive to be suffecient proof,(I want to see these so called "lewd" texts) I will lock his cell myself. I do not belive that day will come however. As a final note, students having there teachers cell numbers and calling them is not unusual, in fact when I woke up this morning and heard what was going on I called one of my former teachers on the phone to try to figure out what the real story was. Additionally, the male teachers at our school, especially the younger ones, often have issues with female students having "kiddie crushes" on them. It got bad enough last year in fact that a teacher had to have a student transfered from his class to prevent the whispers from starting. Lastly, I have to include a bit of mud-throwing, if the rumors at my school are true, his accuser is most definatly what would be colloquially defined as a "slut". i stand to be corrected. coach harry lied on his application and on his war record. he was not a specal force man and he was not a football player. coach not just lied to his wife and he had ten phone numbers from girls in school some was 15 and 16. i do not trust this school anymore and will move my son back to sandy creek where they do not make the news so much. oh yes also he was already once this year caught doing this same thing and mr stillions hid the fact that he was doing this. mr stillion also hid another coach at mcintosh when he was their too! so mr stillion can also get fired as far as i am concern!

Teenage girls and boys have had crushes on teachers since the beginning of time. I don't care if she walked into his class naked. He is the adult in a position of trust. As a high school teacher male or female you have to know how do deal with these situations when they arise. Do not become a teacher if you cannot accept that position of trust.

I do agree with you that prison time should be given to child sex offenders (of course the time in prison based on the severity of the offense), but wouldn't castration be a little to harsh? Heintz should be jailed and not allowed to work with children again, but not castrated.

As sad as this is, it shouldn't come as too big of a surprise. There have been numerous teachers / administrators in the Fayette County school system who have been guilty of inappropriate texting and e-mailing. Not necessarily with other students, but with other teachers, etc. It was rumored that even an assistant principal in the school system has been guilty of this in recent years. As mentioned in previous post, it takes two to tango. But this is going on underneath the Principals nose. How does she / he hold the colleagues under his / her command accountable. While administrators obviously need to keep a watchful eye on the students at all times, they also need to keep a watchful eye on the teachers and even people in higher positions as well.

Agree 100%. What I was getting at was, we need for the head principal of the school to hold his / her teachers more accountable. Check in on them more often, know what they are doing throughout the day. There's not enough accountability, and it starts from the top down.

As an upcoming politician, I would like everyone to know that the girl involved in this incident with Mr. Heintz is not as innocent as people may believe. She is a fault too. How would Mr. Heintz have gotten her number? The most likely reason behind this is that she gave it to him. She knew what she was doing was wrong! If she didn't, then she should be placed in remedial classes. Now I am not justifying Mr. Heintz's actions; however, I am pointing out that the whole spectrum behind this incident. This was not a random text message. It was sent for a reason. Reasons that are not clear as of now. NOT disreguard his 8th amendment right (No excessive bail, fine, or cruel and unusual punishment) especially for a former U.S. Army soldier that has fought in the heart of battle in foreign terrain for our freedoms that we enjoy today. You're probably right. The girl is probably far from being blameless. However, that excuses Horny Harry in no way. His job was to mentor and guide our children in making good decisions and not to undress and molest our children.

It is a proven fact that a teenager's mind does not mature or fully develop until they are in their mid twenties. Essentially, this girl still has the mind of a child while being trapped in body of a young adult. You think the adult here isn't at fault? Are you crazy? A teacher has certain responsibilities and one of those is to maintain his or her authority over their students. As a male teacher - it's gotta be all business. You have to set the tone that you don't flirt, hug, tease, call or text your own students. This can only escalate into something bad. As a parent, we all need to do what this girls parents did and check our kids emails, texts, pix, etc. and be on top of whatever they are into all the time. I can only imagine what both the coach and his wife and the girl and her family are going thru right now. Maybe this is a wake up call to all of us to be more involved in our kids lives. If found guilty, let the courts decide the punishment. If not, I hate that he has been put thru this. He'll never be a teacher/coach again.

he'll never be a teacher/coach again. I know of times when a 'situation' was swept under the rug, administration knew, no charges were pressed, but the wrong was done. That person is now a teacher again in North Georgia. Basically all coach has to do is wait until the dust settles, move away and start again.

Mr. Heintz is the only one who needs some serious therapy. Any adult who thinks a teenager is attractive, in an adult way is seriously ill, and has at the very least self-esteem issues. What more can I add to your excellent analysis? Unless I repeat your advice about wooden spoons (a whip would be more appropriate for the teacher), but that would likely be taken the wrong way by this man. Shocked

I hope that parents will demand accountability and punishment and not allow this type of behavior to be ignored (as happens all too often) because it will only get worse. TV, movies, music, and pornography encourage sexual misbehavior. Teens try to imitate what they see to find acceptance (and a caring, attentive father figure), and adults take advantage of teens' immaturity and emotional needs. Boundaries need to be maintained between students and teachers so that they don't become too friendly with one another and natural barriers are eroded. Do administrators look out for teachers' inappropriate behavior? Are teachers trained how to deal with young girls' "crushes" and how to maintain the appropriate distance necessary in the student-teacher relationship? Do parents and educators teach kids about inappropriate adult behavior, or is the emphasis just on young children?

If you've ever seen Dateline's "To Catch Predator" series, then you were probably shocked by the way the adults prey on kids and how quickly online conversations turned sexual and how "respectable" men would risk going to jail. Maybe that's because all too often plea deals are made or charges dropped, if they were ever brought in the first place. The perverts didn't seem to fear meeting an angry father (or mother) either.

Parents also need to stop the sexualization of their children (i.e., looking and acting like trash, as my grandmother used to say) -- music, television and movies, clothing, etc. I've heard so many say that far too many parents are too busy working and/or socializing to have any time to discipline and mentor their kids -- to teach them values and self-discipline. They give them money to get them out of the house and then let them raise themselves.

Whitewater High is a great school, there just need to be a few adjustments... starting with stillions, and tutterow... who can't hurt a fly... lets his "friends" (students) get away with anything and do anything... as a studet at whitewater i know that every school has their kids who drink and do drugs, etc... but it upsets me to know that our high school is the newest in the county and we already look like trash, because of what a hand full of students have done.... take a look at the real students the ones who are trying to get an education and get through all this crap... the students here at whs are nothing compared to what other schools are like in this county... i will admit though the administration in other schools might be way better than ours... we just need a better man who can hold this school together up in the office in the big chair... so hand it off to Vena!! Last year's Senior Night at SCHS was great. I knew that as I walked across the track, I had accomplished many things at my alma mater and proved that anything is possible if a person tries.
