TYRONE MANAGER UNDER INVESTIGATION

The State Bar of Georgia is investigating Barry Amos for the unlicensed practice of law. GA Law states, its unlawful for anyone without a license to engage in any kind of legal activity. The Bar complaint alleges that Amos has been writing Tyrone Ordinances. Tyrone regulations state that all ordinances and resolutions must be approved for form and legality by the Town Attorney. In the past that approval meant the Attorney would sign each document. Attorney Brad Sears did not sign Ordinance 454 and others. Former Town Attorney John Mrosek and Amos often had disagreements over legal matters. So much so that Mrosek said he resigned in frustration. Mrosek did not sign Ordinance 341 which Brad Sears says is Tyrone's Zoning Ordinance. Mrosek's name under Approved By: is typed in but, no signature on the line. The ultimate penalty for practicing law without a license is prison. Councilwoman Grace Caldwell says other complaints have been made about Amos' unlicensed practice of law. Caldwell also accused Amos of misrepresenting sewer usage to her at a recent Council meeting. Misrepresentation is a form of fraud.

Barry Amos' fear is palpable at this point. It is clear that he is shaking in his little shoes (short man syndrome). Even one of the ex - planning commission members told a local business man that the Shelley lawsuit had Tyrone Town Gov "SCARED". Ha Ha Ha. It won't be long. Barry's bullying is coming to end very soon!

By the way, you obviously "ain't no Einstein" either!! Resorting to inapplicable and unrelated assaults on Mr. Shelley for asserting his property rights in the face of the facist Amos, that is absurd. No one is scared of you Barry. You are a loser!

to be the one to break the news to you, but anyone can write an ordinance. There is no stipulation in law that ordinances are to be written by a licensed lawyer.

Performing acts required or ordinarily performed in carrying out one's duties of employment are not 'practicing law' and are not unlawful.

Holding oneself out as an attorney, willfully, and knowing that others believe one to be an attorney or capable of performing acts of an attorney is unlawful.

Tonto - you are WRONG!!

The state bar of GA clearly states in its' advisory opinions that the writing or drafting of ordinances (laws) by a non-attorney is the unauthorized practice of law!! I did my research, so if you don't believe me, research it yourself.

to be the bearer of bad news, but the state bar of Georgia does not decide what is or is not illegal, or in this case, practicing law. That is done by the courts.

These are the same people that brought snakes into the discussion & then would not cite any evidence to back up their claims. No snakes attacked a fisherman at a lake in the city & ate his fish (where ever that is...most of us on 74 didn't know there was a lake), or the one who "witnessed" a skier's death & finally (my favorite poster) who "remembered" reading of a death by snake on the log flume.
THEY HAVE NO CREDIBILITY.
It's why none of the local papers write their "investigations." Why the AJC probably won't either & certainly why you won't see the news trucks.

Hate to break it to you but the AJC has already expressed serious interest in the overt violations of people's right by Barry Amos.

I agree with you mudcat. It takes time, hard work, and patience to expose and over-through a corrupt person in the local government like Barry Amos. But not to worry, Barry has ticked off so many people that they are waiting in line to get a piece of him!!

I..was not the one that said a snake attacked a fisherman. I am the one that said..cotton mouths are aggressive, and they are. You also stated that cottonmouths are not in Texas, they are. I have seen a zillion growing up, and they do bite under water. How do you think they catch fish or anything else in the water? They bite it in/under the water. They would STARVE if they couldn't! I WAS at the lake when they guy was put off in the willows and was bitten so many times he was dead before he got to the hospital. If you don't think snakes hunt under water, and that more than one are in the same place and that they do bite anyone that intrudes, then you need to grow up. I saw it happen, I am not going to swap tales with you, you are a jerk! No one is going to tell you cotton mouths don't bite, nor that they are not in nest/groups/balls, in the muddy water cause they are. you are stupid! Go write an ordinace against that!

Yes, water moccasins can bite underwater, you at least got that right. However, they hunt mainly near water, not under water. Their main diet isn't fish, it's frogs, lizards and small birds. The bit about swarming snakes is a very old hoax from God knows how long ago, and if you think it's ever happened, let's hear about some proof.

bladder ol buddy, I saw a man throw a bag of money in the "nature preserve"(that's PTC for swamp). Go to the part of the trail that has no homes on either side, just south of braelin.

Don't worry no snakes or teens to bother you.....really.....it looked like a big big big bag of money....go on ....go help yourself. You know you want it. If you see a snake say BOO and it will go away...promise.

Dear Tonto707, I hope you are not running for council? We have too many stupid people already on it. Apparently you have not read or understand Tyrone law which states all ordinances must be approved for legality by an attorney. If not, then you are practicing law without a license. The fact is, the Georgia Bar is concerned and will investigate. Read O.C.G.A. 15-19-50 regarding the definition of practicing without a license. On second thought don't try to read it. You obviously cannot understand it. Some people are so dumb, they don't even know they're dumb. You're making a fool of yourself to all the readers. You're not the Ranger's Tonto, you don't even know which end of the horse to ride.

If your "source" is in fact an employee or investigator for the bar association, then he or she should be FIRED for divulging information about an open investigation to a third party. The loneranger, thank you for this information, if it is true. I know that my dealings with Amos has not been so enjoyable either. I have always felt as though he has the Napoleon syndrome whenever I spoke with him or witnessed him at a meeting. I just hope that if you are the one that is suing the Town, all this dissemination of information does not tip your hat to them and hurt you in the long run. I for one am very happy to see that Amos is finally getting what he has dealt out all these years. I do question what will happen to his accomplices, Sheryl Lee, Valerie Fowler, Paul Letourneau and Mike Smola. Do you happen to know how they will be effected through the practicing of law by Amos? Also, what type of lawsuit will this expose the Town to in the long run? I know that Amos made the statement in the past regarding the fact that he was not concerned with a lawsuit as that is why we pay for insurance coverage. But he does not live in Tyrone and does not have a vested interest in what happens to our town. Thank you loneranger for exposing Amos and his clan for what they have done to our town.

Just one question(OK more than one): How do you know he is being investigated? Did you bring this complaint up to the Bar Association? Is this part of the "lawsuit"?

Seems farfetched to me, but a formal complaint might be just enough for the town to rid themselves of this bad boy. If he is proven guilty then Tyrone could avoid paying off his contract.

Mr. Mrosek, step forward. It is your time to be on stage. Take charge of this and be a hero. Tyrone may hire you back after all. Why not. If Webb can come back to PTC, so can you.

He serves at the pleasure of the council according to Tyrone law and because Amos stated so himself in response to an open records request to see his contract. Incredibly some council members did not know if he had a contract. Tyrone is a citizens do it yourself investigation without any help from the council. Mr. Mrosek should step forward but he is afraid and is hiding behind his attorney-client priviledge. The State Bar will be contacting Mrosek. Sooner or later, the whole rotten mess will be proven. If Mr. Amos is as smart as he thinks he is; then he should start now looking for another job and turn in his resignation. Those of us who know the truth are not going to stop until justice is finally had.
