Maxwell asks Horgan to resign from commission

Fayette County Commissioner Robert Horgan has been asked to resign by one of his fellow commissioners in the wake of his May 23 arrest for misdemeanor marijuana possession and driving with an expired tag.

In a letter provided to The Citizen this evening, commissioner Eric K. Maxwell (pictured at right) indicated that he has asked Horgan to resign. Maxwell noted that his conclusion is shared by an “overwhelming” amount of dozens of Fayette residents and a number of county commissioners from around the state.

“... The only reasonable, the only honorable and the only justifiable action that should be taken is the immediate resignation of an elected official who violates the public trust,” Maxwell wrote.

Maxwell noted that he has lived here since 1972 and cannot recall a similar occurrence with any other local elected official.

“It is not only a privilege but also an honor to serve in an elected capacity. But with that privilege and honor comes the heightened scrutiny of one’s individual actions," Maxwell wrote. "As an elected official one is placed in a position of trust by the public. The voting public has the expectation and the right that all elected officials serve with the highest ethical standards and integrity.”

Maxwell characterized Horgan’s arrest, in which he admitted to the deputy that he was smoking marijuana while driving his truck, as “an event ... that no reasonable voter, including myself, could anticipate or should tolerate.”

I agree with some of the posts below about Horgan's head on a platter as a way of taking people's mind off the Fayetteville bypass.

If I remember correctly, Jack Smith took an all expense paid trip to China with Harold Logsdon from the new Chinese company. Didn't hear Maxwell talking about integrity then???

The bypass is a rip off and it's far more important than Horgan who will be handled by the courts. Don't fall for the county smoke screen.

The BOEer's Smith and Smola are out next time, and so are Jack Smith, Maxwell and the others who vote for the bypass.

This ole farmer don't like Maxwell or Horgan either but I did some checkin on the county records and the China company paid everything but the airfare which was bout 965 round trip for Smith and that Krakol feller.

Logston and Bernine went first class and cost them PTC taxpayers $3500 a piece!!

I'm a withya if you want to bill Harold and Bernie for the difference.

The lone voices in defense of good government who have public forums for expressions. I’m particularly impressed with the courage of commissioner Maxwell to speak out against Robert Horgan. All other elected officials are too cowardly to stand up for ethics. When the voters go to the polls, they should remember to vote against incumbents who don’t stand up for right versus wrong. Right now Maxwell is the only one who should be re-elected in all of Fayette County. Vote out the silent majority of pro-dopers.

Horgan has made nothing but good solid votes since he has been on the board. He has not cost this county a cent! Unlike Greg Dunn and Linda Wells who cost the county well over $500,000 in court and attorney fees suing Sheriff Johnson, with tax payers money. He helped get rid of the Fifth commissioner “McNally” and started an in house county attorney. He has not cost the county money like Harold Boost, past county commissioner who lied about his residency and was booted out of office and cost the county well over $100,000 dollars for a special election and we got Peter Phifier, need I say more. Have you people forgotten about this!! I saw in the new today where a county employee in Fairburn stole well over $30,000 dollars and they can’t do anything about it. He has not cost this county a cent. But if we get rid of him now it will cost the county over $100,000 dollars for a special election. That is tax payer’s money, that we do not have. Do you want to waste your money on this matter? May be we just need to keep a better eye on him. I like Maxwell but!! He sued the county over signs and the county lost and had to pay him over $20,000 dollars while he was in office as a commissioner. Slow you roll.

First, you don't understand that it is not a waste of money to get rid of a wasted commissioner.

Second, Horgan did cost this county money. He voted to give county employees 3 days off at Christmas and 3 days off for New Years. That cost us money; we had to pay these people not to work. And he voted in favor of a pension plan in the worst economy since the great depression. I mean, we are a giving county but my budget (like most folks) isn't unlimited. Our taxes are going to pay for that.

Third, the Fairburn situation involves purchase card (P Card) abuse. Dunn and Wells got rid of P Cards; Horgan and company bought them back. And it is only a matter of time until some slick employee abuses the privilege.

Fourth, the whole "but Dunn and Wells cost us money" thing is getting old. Was it a power struggle? Yes. Was it necessary? Since we'll never know how Johnson was spending the drug seizure money, no one can really say yes or no. But, be clear about this: anytime one county constitutional officer sues another, the county has to pay the other party's attorney fees because both parties have an equal right to use the county attorney. Once one side has used the county attorney to sue the other, they have to pay for another attorney to provide for the defense. Bottom line, we would have gotten stuck for the attorneys fees whether Johnson won or lost.

Horgan can step down and cost us nothing or we can force him out. Either way, TIME TO GO.

This was the offer I saw on the Citizen for Mr. Horgan's Mr Transmission. I wonder if he is willing to to extend that offer for votes of support? Or is he buying adds to purchase sympathetic support from the Citizen? Or does it make you wonder just how much a transmission repair is 'padded' in that it allows such an extreme giveaway to accompany a repair. Either way this voter sure feels like she is being taken advantage of by Mr. Horgan as a commissioner and a businessman.

What is that aromatic aroma that I smell when passing by Mr Transmission?

Horgan will not step down, the man thinks he is above the law. Its a simple case of someone ( Horgan ) believes who can do anything to me? Unless the gov happens to gets involved, Horgan will play the game until the end... Horgan reminds me of another politican from the 90's Bill Clinton. Deny, deny, say your going to the peoples work, then hope the short attention span citiizens move onto something else.

Horgan do the right thing, time to man up...

As for Maxwell, what, it took you long enough to speak out. Maxwell like most of the commission should be looking over their collective shoulders as well.. We're watching the whole commission to see who steps up and who sits this one out...

As for the postings that the board could appointment someone,there is nothing in the rules that would allow for that to happen... Horgan is not close to his term being over as well, he was just elected in 2008...

Maybe if the economy wasn't in the news, and the way PTC and the other cities are handling their budgets , this matter might have been a one day story... But americans are tired of wasting money and time dealing with politicans who aren't interested in following the same laws we do everyday..

I still hold out hope for more charges against Mr Horgan, could a DUI charge still be forth coming? Since he admited he was smoking while operating his truck..

Horgan is so late in his term that if he resigned the commission would appoint a replacement and that person would have an incumbent's advantage come November. So, who would they appoint? Sam Chapman? Steve Brown? Greg Dunn?

See why we should leave Horgan alone?

Horgan was just re-elected in 2008. It is NOT so late into his term that a special election cannot be held. Don't you recall that Horgan was elected in a special election in 2006 to fill the un-expired term of A.G. Van Landingham.

And, FYI, there is NOTHING in the Fayette County Code that allows the Board of Commissioners to appoint another commissioner. (Thank God for that.)

The WFB vote mingled with this is smoke and mirrors on the commissioners part. Now they don't need Mr. Horgan. Asking for resignation and postponing the vote would've been more appropriate. What's the hurry? Oh, I forgot...they want another 5 years of SPLOST and needed to spend the money to justify this "Parkway."

Third, "Smilin' Jack" should have initiated formal censure proceedings against Mr. Horgan when he found out the facts of the case. I suppose Smith needed Mr. Horgan's vote last night. Misdemeanor or not, Mr. Horgan was "ridin' high" in my neighborhood.

Thank you, Commissioner Maxwell, for asking Commissioner Horgan to resign. However, if you're really serious, why not ask the other Commissioners to censure him? While the Commissioners can't unilaterally remove Horgan, they must exhaust all administrative remedies they have available to them to get it done. The buck stops with Governor Perdue, who does have the necessary authority. The people have made it crystal clear that they do not want Horgan to remain. If you are for the people, you can't turn the matter loose until you've done all you can do to remove him, and that demands more than just asking for his resignation.

Garbage, Mr. Horgan should get the same consideration that all county employees get. He can get help through the EAP and re-test after 5 days. He should be sent home for a 5 day suspension without pay. If he follows the guidlines set forth by the County then he should remain as a Commissioner.. This is County policy, he is a County employee. Get your facts straight. You people that ask for him to leave I'm sure you have no past you are ashamed of. What people.. Are you posting for Dunn?

Horgan is not unlike the multitudes of other corrupt or lawbreaking politicians that get caught and continue on as if no wrong-doing has take place. Heck if you think about it how rare is it for one of these clowns to actually 'own-up' and bow out gracefully?

Indeed Horgan needs to go.

Hey! I'll bet Aamco Transmissions must be a great place to work if you are a pot head. Does anyone else get the feeling that Horgy and the boys burn them pretty reguarly while rebuilding your transmission? No wonder those trannys never quite sound or shift right after leaving the Aamco bays.

Spoken like a true politician Maxwell, I just hope you never get any kind of misdemeanor charge. We will ask you to resign. Better keep the speed down in your “I will sue white Corvette” How many attorney friends of your's that have received a misdemeanor did you ask them to resign from the bar? I bet Horgan is the only person you have asked to resign. All of your attorney friends do nothing wrong.

If other county employees have been fired for failing drug tests ect.. then why not ask him to resign. I believe it's the right thing to do. At the same time I have a young child who enjoys reading the local paper that has asked me about this incident. What kind of example does he set by not resigning.

I really do not know much about Commissioner Maxwell but it is good to finally see a commissioner show some leadership on this issue. A Horgan resignation is the ONLY resolution that makes sense.

This is even making district voting an issue again and clouding the issue. I guess if he had been voted in by district voting it would be okay, at least that is what making it a factor implies. The old he may be a crook but at least he his our crook philosophy.

If he doesn't resign a countywide recall should be attempted and I believe should and would get support from all over the county.

HORGAN MUST GO NOW!!!!

Great that you stepped up on this issue. Now the question is, will HORGAN be a man and resign or do we have to run him out of office? This will not and should not go away. The presumption of innocence only applies to criminal cases. He admitted guilt and even tried to bribe the officers. (Well, maybe he is a criminal.) He will probably at the very least be on probation and could have his drivers license suspended. Have we ever had an elected official on probation and having to be driven to the meetings? Oh, he will probably just go on driving since he is above the law anyway. The man is a disgrace. RESIGN NOW MAN.

All, you may be the most vocal, but the real decision needs to be made by the voters, not by you. Let the system work and he'll either be returned or removed in the next election. It's called "The Democratic Process".

No Sir, the decision needs to be made by someone who's got the guts to say "who the hell do you think you are?" to these elected officials who think they can do whatever they want. We shouldn't have to wait until election time for a decision to be made to take someone out of office or not (at least when committing a crime is involved). Its our County not his.

He's shown that he doesn't care about the laws of the state, and he put other drivers and families on the road in danger. One can only assume he doesn't give a crap about his community or the residents on which his decisions (as an elected official) affect.
