Judge Sotomayor apparently "empathized" more with New Haven, Conn., government officials than with white and Hispanic firefighters who were denied promotions by the city on the basis of their race.

Let's hope she's as empathetic to New Haven residents who die in fires fought by inferior firefighters as a result of her decision.

So far, what have conservatives who are too embarrassed to call themselves republicans and republicans by name offered against the nomination of Sonia Sotomayor?

She is empathetic.

She says law is made in lower Federal Courts.

She is a racist because she feels her background has to be considered by her as she forms judgment.

She may be "emotional" (code word for woman, who we all know are too emotional, right?)

Well, let's dive in.

Law is often made, and legal precedent set, in the lower federal courts/

So is the opinion of Justice Antonin Scalia. In this Cornell University posting of Justice Scalia's written opinion, he specifically states,

This complete separation of the judiciary from the enterprise of "representative government" might have some truth in those countries where judges neither make law themselves nor set aside the laws enacted by the legislature. It is not a true picture of the American system. Not only do state-court judges possess the power to "make" common law, but they have the immense power to shape the States' constitutions as well. See, e.g., Baker v. State, 170 Vt. 194, 744 A. 2d 864 (1999). Which is precisely why the election of state judges became popular."

Justice Scalia stated that this power exists in the state courts because many cases never are reviewed by the highest court, and therefore will not be shaped by The Supreme Court's opinion.

So, my fellow republicans by name and deed, where was the outrage towards Scalia when he specifically said, "state-court judges possess the power to "make" common law?"

Where was the outrage when Scalia said state court judges "have the immense power to shape the States' constitutions as well?" I missed the names you called him Gitreal. Missed your outrage "fred" the fake.

Oh, but she is also a "racist" who will consider her own heritage in her decisions as related to prejudice, immigration, discrimination, etc. You would think she is the first Supreme Court nominee to have said this.

And you would be dead wrong!

Well, golly gee! Sam Alito let his background shape how he viewed cases. He is empathetic. And Oklahoman Republican Tom Coburn really liked "seeing his heart." And you guys said JACK!

And you never dared to post Sotomayor's complete statement. Because it mirrors Sam Alito's. Well I'll be a democrat's cousin! I do believe we are starting to see through the attacks.

Conservatives have joined the no ideas, attack, attack, attack movement. Some of you talk like "Weathermen," thinking seccession and /or armed revolution. Some just grossly mischaracterize the country you claim to love as socialist, Marxsist, and communistic; the country run by people who the majority of Americans voted for. Lead by the President with 60+ % approval ratings.

You begin to see the conservative movement as being desparate, allowing its message to be shaped around veiled racism and sexism. It's as if the loss of power is not due to any of their own shortfalls. It's a plot; a conspiracy. A celebrity president that out shined their own celebrity Palin. The desparation will win no elections. The "she's a wench" calls toward Sotomayor will gain no Latino, women, or even-tempered votes for your party.

And it basically serves to rob the Sotomayor debate, as well as many others, of intellectual honesty or integrity.

Excuse the cut and paste but I thought this was interesting and is somewhat reflective of what they are saying in the UK about this pick..

1. The Obama administration had to be aware of this case and its possible landmark reverse-discrimination consequences when they did their due diligence background assessment of Judge Sotomayor. They nominated her anyway.

2. Obama has indicated that he wants to have her seated by the time the Supreme Court begins its next session in October.

A Term of the Supreme Court begins, by statute, on the first Monday in October. Usually Court sessions continue until late June or early July. The Term is divided between “sittings,” when the Justices hear cases and deliver opinions, and intervening “recesses,” when they consider the business before the Court and write opinions.

If the court does not rule on Ricci v DeStefano before they recess, Sonia Sotomayor could be a sitting Justice when the ruling is made on her own dismissal of the case. Would she recuse herself? And even if she did, would the Supreme Court have the guts to possibly taint themselves by returning a ruling against one of their own?

If the court issues a ruling on Ricci v DeStefano before they recess, and they overturn Sotomayor's decision before Sotomayor is confirmed, would that very decision not stop her confirmation? Otherwise, the Supreme Court would have a Justice whose decision had been overthrown by the very Judges with whom she would be working on the Supreme Court.

If the court issues a ruling on Ricci v DeStefano before they recess, and they do not overturn Sotomayor's decision, I would expect her to be confirmed. I would also expect that if that happens the chance of legally overturning reverse discrimination practices would be nil for a long, long time.

This leads to only one conclusion. The nomination of Sonia Sotomayor is not about her qualifications. It is about the landmark reverse-discrimination implications of Ricci v DeStefano.

I believe that it is essentially Obama's game of 'chicken', with the Supreme Court and the Republicans in Congress, to preserve the race card and the laws of affirmative action. Both of which got him to where he is today.

If the Supreme Court were to overturn Sotomayor's dismissal of Ricci v DeStefano, whether she is a sitting Justice or not, the playing field will be changed forever.

The stakes are very, very high.

The nuts are grasping at straws. The US District Court ruled that the city's actions were within the law. the question before the Appeals Court was whether the city's actions were legal. They were. Now we've got the spectacle of the right wing loons bemoaning the fact that a Supreme Court nominee didn't legislate from the bench but rather ruled according to the law.

You think Fred thought this up himself and actually objects to it? Of course not. He was fed it by Rush and Sean and Ann and having no background or knowledge enough to evaluate it (as usual), jumped on it with the ignorant assumption that everybody else could be fooled into thinking it was a real issue like he was.

Surprised but pleased with the decision!

As to the politics of it, it means nothing. Her “60%” reversal rate, so highly touted by the wingnuts, is a 3 out of 5. Sounds worse when you describe it as 60% doesn't it? Sotomayor wrote 120 decisions as Appellate judge so she has been reversed on 2% of her decisions. Her SC reversals are still less than Alito's was by the way and not unanimous as with the Roberts reversals. Less than average too. The Supreme Court reverses an average of 67%. 2007 was an anomaly with 61%. Last term it was 74.7%.

All the political huffing and puffing is just entertainment not serious commentary. Not that there's anything wrong with that as long as people don't believe it or think it's significant.

But I'm still pleased.

the Civil Service Board was acting to "fulfill its obligations under Title VII [of the Civil Rights Act] and dismissed the test because not enough minorities passed. So can somebody please tell me how potential candidates can be screened so that only the most qualified are promoted? I hope we don't go down a path where each race has it's own unique qualifying standards.

The silence from the 'right' is deafening. Sotomajor will govern according to 'law'. Our Supreme Court has interpreted our Constitution since the Court has been in session. All justices bring to the court not only their knowledge of the 'law' - but also their experience in interpreting the 'law'. It's interesting that when the interpretation of the 'right' is not validated - then that particular justice is legislating. Fred is an excellent example of a Rush/Coulter puppet.

I read Cohen's article, IMO his statement: "Indeed. And as Cohen says, “Obama’s Supreme Court nominee ought to be able to look the New Haven fireman in the eye and tell him whether he has been treated fairly or not. There’s a litmus test for you" is absolutely wrong. I can live with the ruling either way but there is no litmus test here. The Appeals Court was not supposed to and did not rule on whether the fireman had been treated fairly. They ruled on whether the city's decision was within the law.

I thought the fireman got a raw deal but that was not the question before the Appeals Court. You say the Supreme Court is expected to overturn. That's not my expectation. Like I said, I can live with it either way but I'll be very surprised if it's overturned.

Also, if I may be so bold, you picked the three most unreliable sources possible almost. Commentary I'll give a pass to as they are interesting in their interpretations of stuff sometimes. The Telegraph and especially the CFP are on the par with NewsMax; just junk. Just between you and me, and I won't tell anybody, do you consider them reliable news sources or were you just being provocative?

Not that there's anything wrong with that.

The main point I was trying to make.. This left v right when it comes to Justices.. is driving me NUTS.. It is supposed to be about the Constitution.. not life history or feelings...The whole mess has become a morass of mixed up politics..

Seventeen white and two Hispanic firefighters in New Haven, Conn., scored high enough on a test to win promotion, but the city threw out the results after finding that no black firefighters hit the threshold.

The white firefighters sued, alleging reverse discrimination, and lost in federal district court. The case then landed in Judge Sotomayor’s courtroom at the Second U.S. Circuit Court of Appeals in Manhattan. In an hour-long hearing last year she vigorously dives into the dispute.

Answer on the way! Lakers won. In a perfect world, my answer would, I assume, be the same as yours. But Hutch - we don't live in a perfect world. Stay tuned. (As if anyone cares what one old 70 year old black woman thinks about this situation). Time for breakfast! If you have the time - read the results of the first court case that found against the white firefighters - and so the case was sent to Sotomajors court of appeals. . .and she found against them. Interesting and sad reading. Our hope is in the 40 and younger citizens who hopefully have gone beyone the mistrust that is the legacy of our past treatment of fellow Americans based on race and sex. This is not my answer - but I'm not avoiding it. As I said three years ago - I came to discuss 'race in America'. . .and this case certainly is worth discussing. . honestly. I'll be back.

You're misinformed here. Minorities passed the test - but the city implements the 'rule of 3'. (Selection to be made from the 3 top scorers) Take the time to read the findings of the first case.

This came from an article published in the WSJ yesterday....
A total of 118 applicants took the two tests for promotion to lieutenant or captain in late 2003, and 59 earned passing scores. Because there were limited vacancies, only the top scorers were eligible for promotion -- a group of 17 whites, and two Hispanics. None of the 27 black firefighters with passing scores was eligible.

None of the blacks were eligible because of the cities 'selection from only the top 3 scores) rule. . and limited vacancies. Get the facts from the source - the court case. Reporters put their spin on the facts. Now the 'right' is saying the court justices put their 'spin' on the law. We'll see.

I no longer am required to kiss anyones anything. your the stupid one. For your information the exams for the revenue department are more difficult than most with the accounting level questions. Hutch's anger is educational for understanding the point of view of a 'white male'. I have no anger, this decision affects me not at all. I've never been in New Haven or been a fireman, except for my Navy training. All I did was ask you a question, period. Yet you hemmed and hawed about it when all I wanted was YOUR opinion. Show me my anger, anywhere in this thread. This reminds me of when I questioned your assertion that 70% of white voters voted for Obama and when you couldn't support the assertion suddenly I was a racist.

To answer Hutch’s question: Do I feel this was ‘fair’? No. Do I feel that the ‘law’ was followed, Yes. We’ll see what the Supreme Court says. The sad reality is that this is all based on the tragedy of racial mistrust in America.

The facts:

The Case Part;icipants:
Plaintiffs are seventeen white candidates and one Hispanic
candidate who took the promotional exams, on which they fared
very well, but received no promotion because without the CSB’s
certification of the test results, the promotional process could
not proceed. Defendants are the City of New Haven, Mayor John
DeStefano, Chief Administrative Officer Karen Dubois-Walton,
Corporation Counsel Thomas Ude, Director of Personnel Tina
Burgett, and the two members of the CSB, Malcolm Weber and Zelma
Tirado, who voted against certification.

The Finding of the Court:

There is no evidence in the record to suggest
that the non-certification decision was made in retaliation for
plaintiffs’ refusal to “associate with,” or their expression of
disagreement with, Kimber. As with the Equal Protection claim,
the fact that defendants desired to avoid the wrath of one group
(in this case African-American firefighters and other political
supporters of Kimber and DeStefano) does not logically lead to
the conclusion that defendants intended to discriminate or
retaliate against plaintiffs because they were not members of
that group. More importantly, there is no evidence in the record
even to suggest that defendants knew plaintiffs’ political
affiliations, i.e., whether they supported Kimber and/or
DeStefano on any issue other than the certification of these
particular exam results. In sum, in plaintiffs’ terms, the
record shows that defendants acted to head off the potential
adverse impact of the promotion tests on African-American and
Hispanic firefighters in order to curry favor with minority
voters and political leaders in the City, but it does not contain
any evidence of an intent or purpose to target plaintiffs for not
supporting that political coalition or its interests. Thus,
defendants’ motion for summary judgment on the First Amendment
claim must be granted. (The Court of Appeals (Sotomajor) agreed with this finding.)

To answer Cy’s concern: Many organizations and cities have implemented a different process for determining proficiency in management skills. To my knowledge, these procedures have not been challenged – and in most cases have produced the desired results – i.e. a diverse, skillful management team.

I hope it doesn’t take another 40 years to have this as a mute issue. (Accepting and 'trusting' that in America men, women and racial ‘minorities’ receive equal access to opportunity and promotion.)

we had a simular issue.. Not enough Minorities passed a promotion exam.. The problem was they did not try to.. While we had tutors and study groups paid for mock exams etc.. Many minorities had the idea they would get a pass.. Their words not mine.. When they didn't .. they screamed rasicm... The end result.. they had their "OWN" exam and we had ours.. Which did more to split the groups then bring them together.. The problem is not racism as Davids Mom likes to protray it.. The problem is a mindset.. They have had a Entitlement mindset for so long.. they just expect to get the free pass..and when the likes of Sotomayor that mentallity just gets fostered even more..
The problem needs to be addressed in their community.. not the courts..

So far these 'schemes' have not been challenged by employees, unions, or cities or organizations that are using this new process. . .therefore - no court action. If the criteria and process is known to all participants; implemented fairly and impartially; and produces the desired results; and the appeal process is viewed as being fair. .no need to go to court. The reality is that this was a case that was judged on the 'law' - and not 'fairness'. The plaintiffs may have been better off going to a mediator - and staying out of the 'courts'. It has now become a 'case celeb' - and the law as written, imho, has been followed. We'll see what the Supreme Court says.

Sensible Republicans are trying to tone down the rhetoric over this confirmation. The process will work. Unless she really comes across like Bush's 'lady nominee' for the Court or Attorney General (I forgot her name) - Sotomajor will be confirmed. . .but with this 'stuff' going on regarding Sotomajor’s sex and race - Repubs are losing the Hispanic and women's vote BIG TIME. And you're right - lose California - and you lose 2012. Interesting politics here. Obama may be playing a very strategic game here. This woman is qualified, experienced, etc. Some are trying to make a Borg out of her. We'll see. The nomination has just about sewed up the Hispanic vote.

When Bob Dornan AKA "B1 Bob" lost his congressional seat due to a larger Latino vote I though it was only a matter of time before the numbers would sway to a more left of center voting block. But you know, they (the Mexifornians) booted out Gray Davis and voted for Arnold so go figure.

BTW, I'm watching how they come to grasp with their budget problem. Hard choices are ahead for them.

California is unpredictable. The reality is the Hispanic population is really very conservative (values, work ethic, importance of family and religion) - but this neo conservative attack on Sotomajor's race and sex is pulling the Hispanic community left of center.
