School custodian acquitted of molesting daughter

A Fayette man was acquitted this week of charges that he molested his daughter dating back to 2001 when she was 11 years old.

Toney Elder, 45, of Old Greenville Road was found not guilty of two counts of child molestation.

The incidents were alleged to have taken place at Elder’s former home in Peachtree City and also at Braelinn Elementary where he worked after school hours as a custodian.

The victim, who is now 18, testified that on one occasion her father inappropriately touched her inner thighs, touching her clothed genital area “a little.” On the other occasion, she claimed that he touched her breasts, also while she was clothed.

The victim, who reported the incident to police in 2007, explained her reason for not reporting it sooner.

“Because he was my father and I still love him,” the victim said.

March 24th Tuesday was one of the happiest days of our life a Jury Trial found Toney Elder Not Guilty of 2 counts of child molestation, In Fayette County? Everyone knows he would not be walking free today if there was a shade of evidence that he did those things his daughter accused him of. But it saddens me because after reading this article in this paper it sounds to me like you want Mr. Elder still guilty of those charges. You never interviewed him not even one statement in this article from Mr. Elder. That means you didn’t care about how he felt or what he had to say. For 2 years he has had to deal with the shame and embarrassment that was brought on him for something that he did not do. Just know this, when you let jealousy and anger get into your heart it will grow and grow and cause you to say and or do anything. The mother of his kids has never gotten past the fact that Toney has moved on with his life he got married and has another family also. This is not the first time he has been accused by her of something he did not do. For instance child cruelty and she never showed in court neither time, but I know you only report the facts right? This list goes on and on and on with her. It is sad how one parent can talk bad about the other parent to the children saying mean and hurtful things filling their head with negativity. Not wanting them to get along with the stepparent. For atleast 10 years we thought that the older the kids got the better things would become between us as a family. But just know this, whatever you instill in your children when they are young it shapes and molds them as they become adults. We can teach them to be loving and kind to others, teach them to always do what’s right or they can take on our bad habits like telling lies and you know the rest…… Sounds to me like Toney Elder is the victim as you put it. and we decided we will continue to pray about our situation. We pray for God’s Mercy. Because God can deal with situations and people far better than we can.

I'm not asking this to start a flamewar, I'm honestly curious.

If a court has found Mr. Elder not guilty, is the Citizen passing its own judgment on him by referring to his daughter as "the victim"? On one hand, not guilty doesn't mean he's innocent, but on the other hand, the court has acquitted him, and there are no longer any legal charges pending against him. Since he's the one the daughter said molested her, the court's decision casts doubts on her accusation.

I think that in this day in age there are so many kids that just say things of this nature to get back at thier parents it is really hard to tell who is fibbing and who is being honest. Not that I would dare call this girl a liar because I was not there but even the accusations themselves are a bit shady. There are so many children in this world who endure horrible abuse at the hands of the people who are suppose to love and protect them that I can't call it necessary to refer to this girl as victim after the fact. Innocent or not without a crime there is no victim and this man should not be hanged in the daily news. True - disgusting child molesters run free in our neighborhoods disguised as regular people as we speak, was justice done in this case? Only God and these two people know that for sure.
