Suspect who 'took money' for sex to be tried later

A Peachtree City man convicted of raping a woman at her Harmony Village apartment was given a 30-year prison sentence by Superior Court Judge Johnnie L. Caldwell Jr. today.

Ulises Chavez was convicted last week of rape and also burglary for entering the woman's home without her permission. Caldwell sentenced Chavez to 20 years on the rape count and a consecutive 10 years for the burglary charge.

The other defendant in the case, Isreal Martinez Ruiz, was convicted of criminal attempt to commit rape. He was sentenced to 12 months in prison by Caldwell.

The victim, 19, testified last week that when she woke up in her bedroom Aug. 30 from being passed out after a night of drinking, Chavez was having intercourse with her. She said that Ruiz then told her they both paid a third man to have sex with her.

The third man is scheduled to be tried at a later date. That man, Jeffrey Donnell Jones, is also charged with rape and burglary.

why did this guy only get 30 while Higgens got 35?

This guy only got 20 on the rape charge and they had irrefutable evidence on him. Higgins got 35 years on nothing more than "he said, she said..."

Higgins was charged with both rape and aggravated sodomy.
They are separate charges which combined to make 35.

Many lessons in this story... I hope people can see that....Ladies, always be aware of whats going on, and that includes not drinking until you pass out.

Judge Caldwell is not a judge I would ever like to face in my lifetime.

Judge Johnnie Caldwell. He's never afraid to sentence a criminal to the prison term the crime deserves. He probably told this defendant he would sentence him to more time if he could. Keep up the good work!
