I've heard that doctors will no longer be allowed to deny a woman an abortion. Even if said doctor is morally opposed to abortion, he/she will, by law, have to do it. There is something wrong with that.

The Freedom of Choice Act, sponsored by Barbara Boxer (and co-sponsored by Obama) on the day after--and clearly in reaction to--the Gonzalez v. Carhart decision. It would reverse the congressional ban on partial birth abortion as unconstitutional and render abortion rights as "fundamental" on a par with, say, free speech or the right to bear arms.

Obama vowed in July '07 to a group of Planned Parenthood supporters that "the first thing I'd do as President is sign the Freedom of Choice Act."

Muddle, methinks you've been misinformed with regard to FOCA.

The actual legislation is a scant three sentences long. To wit:
1. Women have the right to have a child.
2. Prior to viability, the feds and state may not impose restrictions upon a woman's right to terminate her pregnancy.
3. After viability of a fetus, the feds and state MAY impose restrictions but NOT if the woman's life or health is at stake.

What has the fringe right wingers in a lather is that second statement. It would do away with those nasty little roadblocks that right wingers love to throw in the way of a woman seeking an abortion:

  • Requiring a note from the sperm donor with his permission
  • requiring a note from the woman's pastor
  • these 24/48/72 hour "waiting periods"
  • being made to watch a video of an abortion
  • being forced to listen to a pre-natal heartbeat
  • being forced to write a letter apologizing to her "unborn child" for her "selfishness"
  • being forced to undergo psychiatric tests to determine sanity
  • various other "scare tactics"

"Partial-birth" (a political,not medical term) is largely unaffected as by definition it is subject to post-viability regulation.

It will have to be reintroduced - since it did not become law under the Bush Administration. I'll keep tracking it. I do have an issue with partial birth abortion. . .but I'm pro-choice/pro-sex education.
