Evander Holyfield in hot water over $1.1 million promissory note

Boxer Evander Holyfield is currently off the hook on the foreclosure of his $10 million estate in north Fayette. But problems still linger with a $1.1 million promissory note reportedly owed to Branch Banking and Trust (BB&T) and $6,000 for past due child support.

The auction of Holyfield’s 104.75-acre north Fayette estate at 794 Evander Holyfield Highway near Ga. Highway 138, including the mansion of more than 100 rooms, was to be held July 1 over the wrestler’s default on a $10 million note with Washington Mutual Bank.

But all that has changed. Attorney Philip Hasty, with the Atlanta law firm representing Washington Mutual, said Monday that the foreclosure process had stopped, effective June 5. Hasty had no other comments on the matter.

But other issues are still on the radar screen of another creditor. BB&T is seeking payment on a $1.1 million promissory note entered into on Feb. 23, 2007, according to information obtained from Fayette County State Court. BB&T is also seeking $28,453 in accrued and unpaid interest and per diem interest of $335.

According to court documents, a Jan. 14 letter to Holyfield contained a demand for payment within 10 days for the note that matured Dec. 1, 2007. BB&T claims Holyfield failed to pay off the note and is in default.

An evidentiary hearing on the BB&T request will be held June 30.

Toi Jenese Irvin, the mother of one of Holyfield’s children, also wants him to pay up. Holyfield in December 2003 was ordered to increase monthly child support to $3,000 per month from the $2,000 per month amount established in June 1999, according to documents from Fayette County State Court.

Those records showed that, at that time, Holyfield had a gross monthly income of $604,000 while Irvin’s income was $2,556 per month.

Irvin’s attorney filed a June 3 petition for contempt due to Holyfield’s failure to make child support payments totaling $6,000 for May and June. Payments are due on or before the first day of the month, according to court records.

Holyfield was issued a summons on June 3 to answer Irvin’s complaint within 30 days or be subject to judgment by default.
