Tyrone facing $1 million deficit

Tyrone’s Town Council continued the arduous process Wednesday night of trying to find areas to cut in next year’s budget.

With a relatively small growth in the tax digest this year, the town’s leaders are looking to trim nearly 25 percent from the town's expected expenditures in 2008-2009. Projected expenses for the town total $4.2 million for maintenance and operation, along with capital improvements, while revenues are only projected at $3.1 million. The bleak financial picture has sent staff, along with Town Council members, looking for areas to cut.

One of the biggest increases the town sees this year is in professional services. Last year, the town budgeted $58,000 for the item, which includes legal fees, but this year’s projected expense is $308,000.

The $308,000 includes $180,000 to Bill McNally’s law firm, along with $80,000 in engineering services and $20,000 for an audit.

“We’ve got a lot of legal work to get done, but maybe we can cut the legal fees down to $150,000,” said Councilman Grace Caldwell.

Other ideas floated included not having the attorney present at all meeting, but town administrator Chris Venice said the more the attorney knew about the town’s business, the more helpful he could be.

The town’s leaders also looked for areas to cut in the public safety department.

Police Chief Brandon Perkins said he could probably wait for another year before purchasing two cars, and in a frank admission, said the department was probably overstaffed by a couple of officers.

The town currently has 19 officers and national standards recommend 16 for a town of Tyrone’s size. Perkins said everyone in his department has plenty to do, but said the overstaffing could be handled through attrition.

The Town Council asked the department heads to go back and re-examine their budgets and see if there were other areas to cut. The town plans to have another budget workshop June 10 and adopt a preliminary budget June 19.

TyroneConfidential everyone that files a lawsuit doesn’t win. When someone can not even find an attorney willing to take their case and has to represent himself or herself; well you know the old saying about that. I do think you are too conservative on the estimated costs of continued government incompetence; that is the only thing this group excels at but then didn’t you help put them in office? Birds of a feather?

When you have a law degree you don’t need to pay a lawyer. And it’s very helpful when you have a close relative who is a lawyer. We’re closely looking for something to sue you and your alter-ego Snell on. Then you can pay a lawyer. In fact I have gleamed info from your blogs that you are already a defendant in my lawsuit.

Without the benefit of any reliable figures due to already found discrepancies in the financial audit, it is possible for most anyone, except our government officials, to estimate the real deficit.

Projected Revenues = $3,100,000

Less:

1) Projected expenses of government operation $4,200,000
2) 12 more mos. avg of Atty Fees = $308,000 divided by 4 = $77,000 per month x 12 = $924,000.
3) Judgment on existing lawsuits:

A. Fired Police Officer - back pay. $35,000. Punitive damages
unknown. $?
B. Zoning lawsuit - Inverse Condemnation only. $385,000.

(a) Plus 1 yr’s legal interest @7½ % during lawyers failed
appeal. $29,000.
(b) Punitive damages for Barry & Valerie’s fraudulent
misrepresentation - Unknown. $?.

4) Allowance for further uncovered audit mistakes 6.5% = $200.000.
5) Allowance for further recession in housing mkt of development
fees - 5% = $155,000.
6) Allowance for further government incompetence 10% = $310,000.

Total Projected Expenses for 2008-2009 = $6,238,000.

Total Projected Minimum Deficit = ($3,138,000).

Possible Government Solutions to Deficit.

1. Grace Caldwell’s hope to reduce atty’s fees from $235 hr to $150
hr. 36.2% = $334,488.
2. Chief Perkins Suggestions:
(a) Reduce 2 officers through attrition =$80,000
(b) Hold off on purchasing 2 new police cars = $50,000.

Total Reduction in Deficit = -$464,488.

Deficit after known government solutions = ($2,673,512).

3. Final Solution choices:

A. Bankruptcy - Sell off government assets.
B. Increase Taxes ($2,673,512 divided by 1,700 households) =
$1,572 per household.
C. Fire Valerie which would automatically increase business
revenue.
D. Make a sincere effort to settle existing lawsuits & void
future lawsuits.
E. Repeal Ord. 454 which would further increase business
revenue.
F. Reduce all employees’ salaries across the board like
private business does.
G. Eliminate the 100% health care benefits of employees.

4. Citizens, which one of the above 7 choices would you least

Why did Brandon Perkins OVERSTAFF by 3 in the 1st place? I was told the reason for letting him stay in that position was he was so bright? Van Brock should rightfully have that job and I doubt he would have overstaffed the police department.

As for police cars, I don't see them in horse and buggys and one of the younger officers has some kind of new little sporty something.

Why do we ...still....have a $75,000.00-ish clerk-ish person on the payroll?

now let me see 40,000 ish * 3 is 120,000-ish plus 75,000-ish is 195,000.00-ish

I want to clarify something in reference to the above posting by oldbeachbear. She has taken the content of this article as it pertains to me and the Tyrone Police Department out of context to once again attack my character and abilities.

The Tyrone Police Department had 19 positions when I was appointed in September of 2007, so for her to assume or to accuse me of overstaffing the police department is incorrect.

We have 19 positions because my predecessors requested them and got approval for them through the Mayor and Council over the past several years. I am not accusing any of the past Chiefs of Police of any wrong doing or errors. I am simply stating fact. I truly believe that they requested these positions due to Tyrone's past history of rapid growth and development and that they were trying to ensure that Tyrone and it's citizens would have adequate coverage in the future. Now that we are faced with a budget crunch and a slow economy, it is apparent that our tax base and other revenues may not be able to support their assessments, but they could not have foreseen the current state of the economy at the times that they requested increases in manpower.

I made it clear to the Mayor and Council at the retreat in February when I presented my 5 year plan that I would not be requesting any new positions any time soon. I further advised them that any manpower increase requests in the future would be based on a proper manpower allocation study that takes into account our call volume, crime rate, and other factors.

The entire content of the discussion that I had with the Mayor and Council at the budget workshop on Wednesday was not presented in the article, so I can see how one could misinterpret the context. Any of the citizens who were in attendance could attest to the fact that I was responding to a question from an elected official about how police departments allocate manpower, how we compared to other agencies in Towns of our size, and if all of our manpower was necessary. My short answer was that we were probably overstaffed by a couple of officers.

I advised the Mayor and Council that all of our people have important duties secondary to patrolling the Town. These include: training, accident investigations, narcotics investigations, public information, certification, internal affairs, criminal investigations, evidence maintenance, community policing, neighborhood watch, etc. that must also be factored in.

There are several scientific methods for figuring manpower needs, none of which are perfect solutions or abundantly accurate. The most basic, and the one referred to in the article, is a simple ratio of 2 officers per 1,000 residents with extras added in for officer safety, off days, sick leave, and vacation time. However, this method does not take into account actual call volume and workload. A combination of methods concludes that a range of 16 to 18 officers is acceptable for us based on all of these above mentioned factors.

Finally, the discussion also concluded that any reduction in force could also raise costs such as overtime due to fewer officers taking on more secondary duties and other factors.

My response was an honest answer that provided the Mayor and Council with information that they otherwise would not have had to use in making decisions in relation to the upcoming budget. Any responsible official in my position would have responded likewise.

I suppose I could have supplied the council with a half-truth or other false information. I'm sure that they would have taken my word for it as they trust me to be honest with them. However, that is not the way I choose to conduct business, so If I am being chastised for being honest and for doing the right thing as a government official, then I accept it with open arms.

You must be a miserable person. You are full of hatred for our towns officers, one person is Chief Perkins. Why, I must ask? Do you have hatred for the officers because you or your family have been stopped or arrested? You mentioned that officers were testifying in court. Is it just possible that is the reason why there were officers waiting in the court room? Have you ever been to other courts? If trials are being held its not uncommon for more than one officer to be in the court room. Please get help for yourself so you can be a happy person.

nope...the 3 people came before me, I saw none of those guys testify in those cases. They pretty much involved the same officer in the ones before me and the ones after me. The only one I can't account for was a 20ish guy from PTC who was alone and I didn't hear his case. Since his was a stop sign too, I doubt he would have had all 3 of the ones against the wall.

The point is the over abundance of police, when a town as of now, is a million dollars in the hole and the year ain't over.

We have a new police chief with not that much experience, and by his own statement 3...at least... over staffed.

You didnt answer any of the questions that I asked you. Why do you have so much hatred for our towns officers? If you were in court, you probably have been stopped or arrested. If youve been in court in Tyrone or other courts, you would know that not all officers are called to testify on all cases. How do you know there werent other reasons why there were three or four police officers in the court room? Are you privy to all that happens in Tyrone? Do you have hatred for all police officers? Ive never seen you with a positive attitude about anything on these blogs not just things involving the police. There have been at least three police chiefs in the recent months, so naturally you must blame the current chief for all that has happened, right? There are doctors that are willing to help you. You can be a happy person if you would allow yourself.

I didn't know that all towns of the same size in America were required to have exactly the same number of policemen! I didn't know that!
Doesn't that kinda depend upon what one does with them? Maybe even something one could do without if necessary? Like hunt computer predators, patrol the cart paths (if you had any), check store doors earlier than 3 am.
As to the highly paid clerical---that has become in fashion! Someone you know to handle details so the boss can relax.

yes it does...when I went to traffic court, there were 4 in the courtroom. 3 that sat against the wall and one that seemed to have written all the tickets and was testifying. But, that court deal is a dead issue with me now.
I think the number 16 would be on the high end, say if you were on the out skirts of Detroit of LAX etc. We are a little berg with very little traffic, not any downtown bussiness area to speak of, and a even smaller industrial area. We have 19 and a new police chief that doesn't even have 1/2 the years with the force as Brock. Who would know better what we need? In such a small area, an overage like that would find little to do.

That court deal is a dead issue, but I don't think you have gotten over it yet.

If it will make you feel better, I'll admit that the only speeding ticket I've ever received in my long life was in Tyrone. I just paid the ticket and went on with my life. There are others who received their first and only speeding ticket in Tyrone, on Hwy. 74.

Now that taxes are going up in Tyrone I guess oldbeachbear and NUK_1 were correct. The old bunch needed to go. They never were able to have a million-dollar deficit for the taxpayers to pick up the tab for. In fact the old group was so bad that I don’t remember them ever having even discussed a budget with such a problem. So toss them out and put in the citizens’ choice, the new group. Of course this new group with evidently an incompetent manager paid $1,000’s more than her predecessor with less to manage, silk stocking lawyers paid 2-3 times what the former lawyer was paid, and the new group(council) drunk on power have managed to place a million dollar burden squarely on the backs of the Tyrone taxpayers in 5 short months. Everyone that supported them and voted for them should be overjoyed.

On June 17th at 10 am, the Board of Elections will have a formal hearing at the Secretary of State’s office for Mayor Rehwaldt, Councilman Tracy Young and Planning Chairman Gordon Shenkle on the charge of Voting Buying in last year’s election. The proper decision for the Board would be to dissolve Tyrone’s government, take away its right to be a municipality and place the town under County rule.

Tyrone just simply doesn’t have any really qualified people who will run for office. We all know what awful conniving representatives we’ve had in the past. So we worked hard, believing candidate’s promises, threw the old conspiratorial regime out and what do we get? Rehwaldt, a weak do nothing mayor just like Sheryl Lee. Tracy Young, a boy Councilman who promises in writing and publicly before everyone that he will “repeal the zoning law”. Then 4 months in office Young votes against changing the zoning. Gordon Shenkle, Planning Chairman whose platform was to “seriously examine the zoning law”, refused to do so and voted against any changes. Cowardly Councilman Eric Dial, who stated at the election forum that the “zoning ordinance might be an illegal unconstitutional inverse condemnation of private property”, recused himself from voting on that issue when it came before Council in April.

Then there are the two left over Councilwomen Caldwell & Furr, who have for two years constantly told property owners that they want to do something about the zoning laws but can’t until we elect a new Council; have done nothing and voted against changing it this year.

Then there’s the new Town Manager Chris Venice, who has not read the zoning ordinance and turns every citizen request over to the lawyer for an official expensive written decision. Although, allegedly having 18 years experience in municipal management. She also tells flat out lies to the lawyer about citizens’ requests; just like Barry Amos did. And her management of the independent overpaid zoning Czar Valerie Fowler is zero, who everyone wants fired.

Last but not least is the incredibly stupid left over retread, and one of the original authors of the unconstitutional zoning ordinance, Planning buffoon David Nebergall.

A correct decision the government made was removing the newly appointed, “I’ll tell everyone how to run their business", while criticizing zoning applicants on the blogs and confusing Federal tax regulations with State zoning laws, Planning Commissioner Mary Sturm. Negating this correct decision, the Council then hired “Bloody Mary” to work on the finances which are one million dollars in deficit and rising. I can visualize Mary’s financial report blaming the deficit on the citizens for not paying enough taxes.

So who created the deficit, I ask??? The monsters!

It was pretty obvious to all that the fine folks running Tyrone like Barry Amos, Brad Sears, Valerie, Smola, Lee, etc. all had to go and most did, one way or the other. I guess Valerie was left in place since no one else would have any idea where to find anything. The problem is the arrogance, immaturity and sheer stupidity was replaced with very similar and nothing really changed except the faces.. So, it's a further continuation of incompetence. Both the old and new guard could give Clayco's school board a serious run for biggest laughingstock, though Lithonia is pushing hard also.

Maybe next Tyrone voters can decide upon de-incorporation of the city itself because it sure isn't working as is.

Do you know the process for abolishing a municipality? I know there is a way. The purpose for having municipalities incorporated is to give citizens better government services. People are willing to pay extra taxes for the right to elect local representatives who live in the community and supposedly will provide better government services than the County. That’s happening in Fulton County & Dekalb now with Sandy Springs, Dunwoody and all the other communities breaking away. We all know why.

But in Tyrone the situation is reversed. Our elected reps have never served the citizens’ needs properly. Too many self interested people get elected who are incompetent, have personal reasons or just simply want egotistical power.

Councilman Tracy Young privately told a friend that he was running because he needed a part-time job to temporarily supplement his income. But he campaigned on a platform to repeal bad zoning ordinances. Eric Dial had never been to a council meeting and wanted to use Tyrone as a base to further his political aspirations. Michael Smola just enjoyed the power; as does Grace Caldwell. Grace moved to Tyrone from Fayette County where she had been in that government. Now she’s brought in Fayette rejects Chris Venice and the McNally law firm who’s costs amount to a third of Tyrone’s deficit. We all know that McNally was ousted from Fayette last year for charging $650,000 in legal fees, which will be larger in tiny Tyrone this year.

There’s no point in paying extra taxes for poorer service. Let’s get the ball rolling to abolish Tyrone’s State Charter, and put us into the County which will significantly lower our taxes.

After more than a decade of irresponsible government, the chickens have come home to roost at Town Hall. One-third of the million $ deficit is legal costs, caused by the government passing restrictive laws, then ignoring citizens complaints about theses laws.

Russell Kirk Jones recently had Tyrone’s application of their zoning decision in his case ruled unconstitutional, causing the government and their lawyers to give up and make a settlement. With other lawsuits in the pot and more coming, Tyrone is headed for bankruptcy. As their revenues decline, Valerie is still running off businesses which further reduces income. Just last week, Valerie ran off one of Wayne Adams' tenants, telling him auto repair is not allowed because, “you will just make a car lot out of your business“. Contrary to the State Fire Inspection laws, Valerie will not issue an Occupational Tax Certificate to the Herb Shop until the owner gets a Fire Marshall’s O.K. Tyrone has no such regulation and the Fayette County Fire Marshall’s office has confirmed that they have no such regulation.

Every single simple citizen question is turned over to Attorney Dennis “the menace” Davenport, who then charges about $450 on average to write the citizen a letter backing up Valerie’s decisions. One recent simple question by a citizen has produced three of these expensive legal letters.

Just like the old council, the new mayor and council and town manager act officially as deaf and dumb mutes to all this, while privately criticizing the citizens and telling falsehoods about them.

Bankruptcy is the best solution to a government whose representatives get elected on promises they refuse to fulfill then once in office turn management of the government over to an expensive lawyer.

You continue to blame Valerie for the denial of applications. She is the town clerk. Chris Venice has the final decisions on those applications and in your own words the lawyers read everything. I know you hold a grudge against her but she is not the one in power here. She is the delivery person for the message.
Most cities and counties will not issue the business or tax occupancies until the Fire Inspector says the business is safe. I have no problem with the city holding off until they inspect the business.
You fail to address the bigger picture of "What is the town going to do to get past the deficit.?" We need more business in the town and we are losing more everyday. There are vacant buildings begging for occupancy.

For the last 1/12 years I have probably written 50 or more articles about the serious problems with Tyrone. All of them included Valerie. People don’t file lawsuits for no valid reasons. Valerie has been a big part of the problem, since Barry was hired in 1995. She is the person who takes applications and is derelict in her required duty to follow the law, specifically ordinance 454 section 1.3.14.

In a Nut Shell, she has made fraudulent misrepresentations about Town business and has been legally negligent in many other duties. I have said so in my lawsuit and intend to prove it in Court. I am so certain I can prove everything I say, that I have just this past week filed a Pre-Trial Order containing 84 documents of evidence regarding her and all of the other Town Officials. If you wish to read it, its public record on file with the Newnan Division, Federal Court 11th Cir., Case #3:07-cv-86. Of course you don’t want to read it, because you are among those who are part of the problems. To prove that point, I invite you to call me at 770 486-6065 and I will meet with you and show you first hand all the evidence. But you don’t have the courage. You just want to hid behind a blog name and take unfounded pot shots. If you are a man, this is a direct challenge to your masculinity. In other words, man to man, I’m calling you out.

Tyrone does not have a business license law. A Tax Certificate is for revenue purpose ONLY. Fire Inspections and Tax Certificates a two different things. Tyrone has no regulation pre-conditioned on fire inspections. Tyrone just illegally uses this to run off businesses they don’t want.

As for the bigger picture of the deficit and vacant buildings; that is a result of the zoning ordinances which I have written extensively about in the past and is at the core of my lawsuit. You have obviously chosen to pay no attention to the fact that Tyrone just this month capitulated on the Russell Kirk Jones lawsuit and made a settlement, because they had to admit that their application of the zoning ordinance was unconstitutional. This unconstitutionality is exactly the essence of my lawsuit. So how is Tyrone going to over-come my legal facts which are the same as Mr. Jones’. Of course you and Tyrone Officials don’t comprehend the law, but I have thoroughly discussed it with Mr. Jones’ lawyer.

Only lawyers are able to stir up more business with their crap.

If they have to spend $200 large ones on this "important legal work" why not put it out for bids? Instead they just hand these hourly billing lawyers the check book and say have at it.

These lawyers will yet again prove that an in house lawyer might be cheaper even for a Town of 5,000 people. I remember a city up north that actually did file bankruptcy.

Don't stick to a rigid anti-growth policy when almost everyone with a brain knew that growth was inevitable. You are on a 4-lane highway to Peacchtree City for crying out loud. You thought it was good policy to ignore growth? What idiots!

If you accept growth and tax it - you have revenue. If you ignore it and it happens anyway - you lose revenue.

You will not see growth in Tyrone. Downtown needs to be developed but you will not see anything like that soon.

this is worse than anything they have done. Tyrone ends up with the PAYING for it. The mayor and cronies were so eager to get rid of the old people that they never considered the cost to the the citizens of Tyrone. The jobs were never advertised, nor was the effect of the budget considered when the new mayor and council met prior to being sworn into office. It is a bad day in bedrock.

$180,000 grand to OverBill McNally and Arrogant Denny? They charge in one month what Tyrone was paying last year almost for the whole year. Then you bring in his sidekicks and all their professional fees. Is this a surprise to anyone? They OverBilled the County and got spanked every time they went to court. Eric Maxwell was right.

No new development and no new business’s plus increased expense by overpaid appointee’s and a town now run by the twin’s not sure it will get better anytime soon!
