DUI "Per Se", or statutory DUI, is indicated where the breath alcohol concentration of the subject is greater than .08g. The state defines anybody over that limit statutorily too intoxicated to drive safely. That, however, does not mean that one is necessarily safe to drive at a lower BAC. If a driver's BAC is greater than .05g, but less than .08, and through clear manifestations show that they are "less safe" to drive because of alcohol consumption, then they are still DUI - but now deemed DUI "Less Safe". Less safe is defined as any loss of ability to operate a vehicle safely caused by the influence of a drug (including alcohol). In some places though, officers cite using the Less Safe subsection of the DUI law in cases where the arrestee refused the State administered breat test and their exact BAC is then unknown. It's hard to say which is the case here.

Is probably not government liquor! Either white lightning or home brew!
Or, it could be a real cheap brand, like "Four Roses" or "Ripple."
Or, it could be torpedo juice--pure 200% alcohol with grape juice.

The paper sometimes report all the cities in the same story. Maybe a separate story will list PTC, Fayetteville and the county. Did "Git" help you out last night with that big meal?
