Man found not guilty of reaching for deputy's gun

Deputy said he punched defendant 4 times to get him to stop tugging at weapon

A north Fayette man accused of attempting to wrestle a deputy’s gun from its holster while he was being handcuffed Aug. 25 has been acquitted by the jury in the case.

Wayne Marshall Williams, 52, was found not guilty Tuesday of the only charge lodged against him: attempted removal of a peace officer's weapon. This was his second trial on the same charge as a jury in March couldn't come to a unanimous decision, resulting in a mistrial.

Williams testified that he did nothing wrong and complied with the orders of two deputies ... a different story from that given by the deputies earlier in the trial during their testimony. Dep. James Pitts testified that he and his supervisor went to Williams’s home on a report from a 911 call that he had tried to run over his wife.

After a brief pursuit up the driveway to the residence, Pitts said he approached Williams’s SUV on foot with his gun drawn. Pitts said Williams didn’t initially comply with orders to exit the vehicle and show his hands. Seconds later Williams exited the vehicle but refused to comply with orders to get on the ground, Pitts said. and the deputy said he then holstered his weapon and grabbed Williams by the front of his shirt, pulling him face down to the ground.

Pitts said he then got on top of Williams and handcuffed his left hand, but then he felt a tug at his gun and heard another deputy shout at Williams to leave the gun alone. Pitts said he then punched Williams four times in the area of his shoulders and head before Williams stopped and was able to be handcuffed.

Williams testified that he never reached back for the gun and never fought with any of the deputies on the scene.

Williams admitted that he was trying to get his wife’s attention just before deputies arrived by driving his Yukon SUV towards her Mustang car, as they traveled in a circle with their vehicles face to face and his wife driving backwards.

“We kind of did a dance,” Williams said. “I might have bumped her, she might have bumped me, I’m not sure.”

Williams admitted that in retrospect it wasn’t a good idea to pursue his wife in that manner, but he wanted to talk to her before she left to take two family members back to college in Alabama. Williams said he was surprised to come home from a seven-hour drive from Daytona to find that his wife had not yet made the trip to Alabama.

Williams said he had driven since about three or four in the morning from Daytona where he had dropped off one of his sons for college.

At first Williams testified that he was surprised when he first saw the deputy’s lights in his rear view mirror because he had no reason to believe they were coming after him. Later in his testimony he admitted, “I thought my wife had called them.”
Williams said he was scared that he was going to be shot if he didn’t comply with the deputies orders after he stopped the SUV.

District Attorney Scott Ballard then asked Williams if he was so afraid for his life that he reached for the deputy’s gun in a bid to defend himself. For a split second, a smile flashed across Williams’s face before he turned serious and again denied the allegation.

Earlier in Williams’s testimony, Ballard made it a point to note that Williams said specifically, “I deny I have any memory or recollection of touching the gun” instead of saying he didn’t touch the gun at all.

I hope Mr. Williams sues Pitts for police brutality. If he was innocent of reaching for the gun, then the officer had no reason to punch him. This cop was obviously on a power trip and messed up. He needed some excuse to justify his use of brutality to arrest a cooperative, unarmed man.

That must have been some jury. Or, that must have been some poor prosecution.

Why on Earth would you consider this a "critical" case?

Seems rather pedestrian to me.

If what DepDawg says is true, I'm wondering why Ballard brought it in front of a jury in the first place. Sounds like it was a very weak case to begin with.

First, after reflecting, I owe you an apology. I jokingly mentioned to JeffC that I did not blog with thebeaver because of his non-civil and racially charged rants and said that he was the right wing version of bas, (you) in retrospect that was not a nice thing to say and I apologize. It’s not that you aren't sometimes over the edge, (IMO) it's the racist component that was unfair and also unintended.

Now, with that out of the way:
Look here.

I fear that this is the tip of the iceberg and will have a chilling affect that is very unfortunate. The police already have a tough job and the absolute worst thing that can happen for our community is for them to be afraid to do their job or to hesitate when they shouldn't.

We are losing officers like never before and the community is growing, changing, and increasingly more urban and less suburban.

The entire incident is unfortunate and, if the reports I read are accurate, the wife gave false information to the police and the jury indeed felt Mr. Williams probably tried to take the officer's gun.

Weak case or otherwise, Ballard, while a nice guy, doesn’t exactly impress our local judges.

the officer could have DIED if that criminal had successfully overpowered him and taken his sidearm. Did you see where he had only gotten the handcuffs on one hand? Handcuffs can be a dangerous weapon if he had hit the officer in the face with them. If the officer hadn't have had backup, this might have had a very, very sad ending.

I don't know if he tried to grab his gun, I wasn't there. Were you?
From some of the take-downs I have seen (Rodney King, etc,)I might fight bending my arms and pounding my head also. In doing so, I may touch his gun trying to get up. I'm sure to some cops, that would be a no, no. He also may have tried to get the gun, I don't know.
Know what you are talking about, believe no one anymore.
People who make guilty judgement before a jury speaks are also generally for jury verdicts, not against as in this case.
Remember we let scores of people out of jail in the USA every year due to DNA testing showing their innocence. Cops, trial lawyers, judges, and some juries just want to play it safe---after all somebody will be in jail.

As an aside, there was no "criminal" act. There was a citizen who was arrested, arraigned, duly tried in a court of law and found NOT GUILTY by a jury of his peers.

In the eyes of the law he is an innocent man.

Of course, this probably doesn't matter to a ghoul like you who has no respect for the law in the first place.

As I said here (Basmati's hero: Fred Phelps), I have a strong suspicion that Rice Queen and Fred Phelps are related. After all, they both talk the same. He's probably guilty like OJ (& probably got off for a similar reason). Why else was the NAACP there?

Hope the woman doesn't really need the police the next time because she might not be believed. I'm so glad that no one was seriously hurt, but going for an officer's gun can get someone shot.

Officers must get very discouraged when criminals get off. I watch COPS (I think that's the name) every once in a while just to remind me what they go through.

(And I'm not blind to abusive officers, either, having experienced some unprofessionalism in the past. I don't just automatically side with the criminal.)

Ballard panders to the NAACP crowd. What do you expect? This is the guy that goes out of his way to vouch for child molestors. Heck... this guy was merely a wannabe cop killer. Why would he be hard on Wayne Marshall Williams? Just because he "only" tried to over power a cop? Come on now.... surely you didn't think that he would harm Officer Pitts.

Apparently a poll of the jurors after the acquittal revealed the following: The jurors beilieved that Dr Willaims did attempt to disarm Deputy Pitts, but they felt sorry for him. His wife had fabricated the entire being struck with a vehicle, him being drunk and having a gun story, just to get the Sheriff's Dept to the house. The jury didn't feel they should send Dr Williams to prison for this when his wife caused the initial response to the house.

PS Rahim's momma was in the court room along with the rest of the NAACP, I bet the county pays out a hefty amount on this. Deputy Pitts, CPL Reagan you guys are top notch just keep doing your job, no matter what the jury finds!

You are in one of the most unappreciated professions in this country. It's a sorry day when a jury sides with a man who attempts to take the weapon of a police officer. Thank God you went home alive and safe that night. This verdict is a slap in the face of all the men and women who risk their lives daily with NO GLORY and NO APPRECIATION, and for so little pay. You are all appreciated by those of us who have nothing to hide and no reason to run. We wish you the best in the future. As for the jury, hope you spend many sleepless nights thinking about this verdict.

Would it be too much trouble to find a jury that is sober this time?? Can we drug and alcohol test these people? How about an IQ test?

Anything that would bring justice would be worth the extra cost.
