GRTA seeks dismissal of TDK suit

PTC wants 2 lanes, not 4 on Line Creek bridge

The Georgia Regional Transportation Authority is asking a Fulton County judge to dismiss a lawsuit filed by Peachtree City challenging GRTA’s requirement for a four-lane bridge across Line Creek for the TDK extension into unincorporated Coweta County.

GRTA claims Peachtree City has no legal standing to challenge its decision, which was tied to the massive McIntosh Village development planned for unincorporated Coweta just across Line Creek from Peachtree City.

Peachtree City contends that it shouldn’t be held responsible for implementing traffic improvements connected to the development since it has no statutory authority over any part of the 3,100 home development. According to GRTA, if the city doesn’t follow through on those traffic improvements by the time the last home is built, GRTA can withhold state and federal funds from other transportation projects in Peachtree City.

City officials have opposed building a four-lane bridge for the planned extension of TDK Boulevard when the city only has enough right-of-way in hand for two lanes. The city is asking for GRTA’s decision to be overturned by the court.

In its legal filings, GRTA claims the city has no legal standing to challenge the lawsuit in large part because the agency gets its powers from state legislation.

Mayor Harold Logsdon has said he doesn’t think the TDK extension needs to be four lanes because Peachtree City couldn’t handle all the resulting traffic. At the same time, Logsdon has said he thinks the road is necessary to keep Ga. Highway 54 from being overburdened with traffic from McIntosh Village and potentially other residential development that could occur in the area.

The lawsuit could jeopardize whether the road extension will be built at all, as the city’s right-of-way is due to revert back to Pathway Communities at the end of Dec. 14, 2009. Officials have said it will take two years to build the bridge, and construction is not likely to begin until the lawsuit is settled and officials know whether the bridge will be two or four lanes wide.

Some Peachtree City residents are worried that completing the TDK extension, known in Coweta as the Vernon “Mutt” Hunter Parkway, would create traffic havoc as McIntosh Village would use the new road to reach Ga. Highway 74 in Peachtree City.

McIntosh Village has been approved by the Coweta County Commission and includes 3,100 homes in addition to 600,000 sq. ft. of retail space and additional office space.

The answer to the suit was filed on GRTA’s behalf by the office of Georgia Attorney General Thurbert E. Baker.

Developer Tom Reese has committed to paying $900,000 towards the cost of the four-lane bridge.

If its built as a 2 lane bridge everyone knows its only a matter of time before its widened to 4. Can our mayor & city council be savvy enough to just sit on their hands and let this die? I'm not hopeful...

Agreed 2 will become 4 lanes. In that case we need to put a toll bridge and charge the Cowetians a heafty fee to use the bridge into Fayette County. Even better, build a movie theater in Peachtree City, surround the city by a moat and we will never have to leave our beautiful city.

The eastern Coweta people can use our new bypass to get to Highway 74, and we don't have to have them clogging up the central areas of our small town.

This is interesting from John's article

So this one is easy, push it back on Doug Mitchell and Steve Black. Let's see them squirm out of that one. With no city buying the land and no tax dollars building the roads, how does the dynamic duo get access to their conference center built on the shore of a lake that they are not building or paying for either?

City and Mayor only have to stall and any lawyer can help them with that.

End result - 0 lanes and no liability and no traffic.

Just because I'm dead, does not mean that I do not care about our fair city.

Not so fast my man.

Yes the stall is a great plan. BUT all it might take is for Pathway to get a piece of the action in the wild wild west (Coweta) to grease the wheels for them making the easement in perpetuity.

That said, as long as 74 gets widened PTC is fairly set for the future so GRTA can hold its breath 'til it turns blue. Gotta agree with Maxwell though it would rock to have an on-ramp onto I-85 at Hwy. 92.

The problem is 74 from 54 to I-85.

A four lane highway costs about $11 million a mile.

We'll need 12 please.

I guess you could use the word "some" even if it accounted for 99% of the people.

Burn this thing. Pave a single lane road to the PCDC property and put NJ barriers at the creek and call it done!

Not to get all scientific on you but I haven't asked the entire city for a show of hands.

Perhaps I could do that at the 4th of July parade, but a lot of us outta-towners show up for that and might skew the results.

I don't see where the burden should be yours.

Maybe the Mayor and CC should put forth a referendum on the subject.

I'll go along with whatever the majority decides.

Just as long as "we the people" get to decide.

Mixer, Please do not attempt to convey/assign your own negative personal experiences to others. I have always found Mr. Munford's reporting & comments to be professional and many times very astute. Given the unfortuate situation we have with Mayor "no new taxes" Logsdon, it is difficult at best to predict where the TDK extension project is going. Logsdon is either incredibly naive, incredibly stupid, or incredibly bought & paid for. A question for everyone: Are deferred payment consulting fees for elected officials legal?
