Two north Fayette residents were arrested Sunday for allowing three children to live in an unsanitary environment in which they were malnourished, according to arrest warrants filed by a Fayette County sheriff’s deputy. Erick Hernandez Martinez, 31, and Ysenia Rios, 31, both of 103 Olympic Court, Fayetteville, were charged with one felony count of cruelty to children and one misdemeanor count of maintaining a disorderly house. The trailer the kids lived in in the Four Seasons Mobile Home Community did not appear to have a working bathroom, and a hole in the floor of the hallway was filled with trash, according to the deputy’s incident report filed in conjunction with the case. There was relatively little food in the home’s pantry and refrigerator, but the deputy noted in his report that Rios told him that’s because she bought food each day to prepare for meals. The deputy also noted there were pillows and blankets on the floor of the living room because that’s where the children slept at night. One of the trailer’s bedrooms was full of items and obviously was not utilized as a sleeping area, the report indicated. A toilet at the front of the house was inoperable and the second was flushed by using a plunger, the deputy discovered. The deputy spotted fecal material in the second toilet, according to the report. There was no running hot water to the residence either, according to the officer’s report. The three children were taken into protective custody by the Fayette County Department of Family and Children Services, confirmed sheriff’s spokesperson Belinda McCastle.
