PTC votes 3-2 to take TDK right-of-way

Facing a midnight deadline, the Peachtree City Council voted Thursday night to accept the right-of-way for the proposed extension of TDK Boulevard.

The vote was split 3-2 as council members debated whether or not the action committed the city to building the road, which will link to a proposed 3,000 home development and shopping center in Coweta County that would border the city immediately on the other side of Line Creek.

If council had declined to accept the right of way, the land would have reverted back to Pathway Communities as of midnight according to the land purchase contract between Pathway and the city's Airport Authority. The right-of-way is on land the authority purchased from Pathway north of the airport to extend the airport's runway safety area.

The motion adopted by council, however, left some wiggle room, as Councilwoman Judi-ann Rutherford said, "this doesn't mean that we agree with building TDK."

Councilman Stuart Kourajian said he wouldn't vote to accept the land because he felt the city was being "bullied" into doing so. Councilwoman Cyndi Plunkett said she didn't want to rush the issue either. Both voted against accepting the right-of-way.

But council members Steve Boone and Rutherford agreed with Mayor Harold Logsdon's viewpoint: that it was better to have the land under city control so the city can ultimately decide whether to build the road or not.

Logsdon said county officials have said they would not build the road if the city doesn't want it.

Rutherford said the city could choose to plant flowers on the right-of-way if it wants, and there will be other opportunities to stop the TDK project.

The Georgia Regional Transportation Agency has indicated it wants TDK to become a four-lane road at some point in the future, requiring that the bridge over Line Creek for the road extension to be made that wide; the extension was intiially envisioned as a two-lane road.

It was clear at Thursday night's meeting that there wasn't any support on council for making the TDK extension a four-lane road.

If the road isn't completed by Nov. 1, 2009, the right-of-way will then revert back to Pathway, according to the contract between Pathway and the Airport Authority, City Attorney Ted Meeker told council.

Most of the residents who spoke at the meeting opposed the "11th hour" deal. Meeker explained that the reversion clause involving the Dec. 15 date was not in the draft contract that was reviewed by city officials two weeks before the property was closed on. The city happened to learn about the impending deadline Tuesday at 10 a.m. when the city was conducting interviews with potential applicants to the Airport Authority, Meeker said.

The city asked Pathway Communities to postpone the deadline and the company ultimately refused to do so.

Kourajian said he wondered why Pathway would want the city to rush into accepting the right-of-way.

I served on the City Council with Councilwoman Judi Rutherford for two years. At times, she could be the stereotypical grumpy Yankee. We all have our moments. However, her behavior at the meeting last night was inexcusable. The guy she verbally abused was sitting right in front of me, and he didn't do anything. That type of behavior is deserving of public censure from the City Council in the event she fails to offer a public apology.

As for the TDK debate at the meeting, Councilman Kourajian and Councilwoman Cyndi Plunkett were on the idealogical high ground. I think their stance on refusing to be bullied any longer by the development power brokers was right on target.

As for Mayor Logsdon and Councilman Boone, they had the same traffic projection data as everyone else, so they had better be trying to figure out some decent reasons for backing the road which enables massive development and thick traffic congestion.

It appears that the only way to get a just and democratic decision is to have the council sanction a referendum vote on the TDK expansion. The people's business is not being well-served if the mayor and council conduct the affairs of the city as they did last night. Acrimony, Petulance, and Confusion run amok. Place all the facts out there on the table and let the voters of Peachtree City decide. We are unable to petition and force a referendum vote. We need to persuade the elected official to allow us to vote on the matter. Is that too much to ask?

In one special election this year the average county precinct voted at about 9%. However, the City of Peachtree voters routinely voted at about 5%. My own precinct, one of the wealthiest, only voted at 3.49%.

So expecting the voters to either care about an issue, or much less vote on it, will be a challenge unto itself.

Mind you, we have had many other elections, such as when we layed palms frowns down in the path of our Current Mayor, as we welcomed our Savior to take over in City Hall. Yes, we had a good turnout fot that, but as a general rule, we are either too busy, too apathetic, or too lazy to get out and vote. Plus people tend to vote when there is something they feel strongly "against".

Heck I didn't even vote in the run off last week for the Agricultural Commissioners post. So I shouldn't complain. . . but that is my right so I will.

The vote was already taken and its 3-2 in favor. The "let's vote on everything crowd" misses the point about how government works and more to the point, they don't do their homework before the election to find out the candidtaes positions on specific issues. Granted that is sometimes doifficult when candidates either don't know or just plain lie - but harold was pretty transparent on this one from the beginning - as he was on the tennis center debt.

Councilman Judi Rutherford is an ogre. I couldn’t believe how rude she was at the council’s meeting. She yelled at this poor senior citizen who did nothing more than laugh at one of Rutherford’s poor excuses for pursuing TDK. She needs to go! Now!

Stuart and Cindy made the most sense out of any of the councilmen. There is no benefit to the road as presented. Both said the city is being bullied by Pathway. The mayor is so close to those developer bullies they could share a suit.

Councilman Boone came off as a complete idiot. He kept saying "we need the road," but he couldn't give a decent answer why.

I had a good talk with former mayor Brown outside after the meeting. He said the reason the revision clause was put in the contract after the fact was that the developers knew that the state department of transportation couldn't start the TDK bridge until all the local governments were in possession of the land. That make sense because why else would the developer make such demands when he already has the money for the land in his pocket? So Stuart and Cindy were right about the bullying.

Mayor Logsdon, Councilman Rutherford and Councilman Boone were just pitiful. The mayor literally said the reason the reason he didn't delay this decision so more public notice could be given was he didn't want to spend $1000 for Pathway's attorney to make changes. He'll pay $1000000 to the development commission crooks and he'll try to double his salary, but he can't spend a $1000 on a huge decision like this one.

They are a bunch of bumbling idiots who can't even lie convincingly. The people have lost control of government.

Surprise, surprise, surprise. The "11th hour" meeting tells me the taxpayers, are going to lose, .....as usual. If we didn't lose this wouldn't be PTC.

Come On, some ONE please explain this to me. This guy does claim to be an attorney? Representing the city? You and ME? How small was the print?

Does anyone know if there is enough Right 'O-way between the FAA and the golf course to 4 or 6 lane this baby? Maybe they could use reverse lanes. I am in favor of a country road "BLVD" but I might feel different about a major artery.

Am I the only one that feels perhaps Stuart has his eyes on bigger aspirations for City Office?...Hummmmm

It may not happen right away, but there is certainly enough land to 4-lane it and within 5 years it will be a 4-lane major roadway. Why else is the bridge being built to a 4-lane width.

It is interesting that Stuart seems to be waking up and paying attention. Looks like we could have 2 factions on council with Boone rubber-stamping Harold and one of the ladies being the deciding vote on many issues. Should be interesting to watch.

What is more interesting or should I say disturbing was Judi –ann’s outburst at the people that put her in the position through an election.

After the vote, those in attendance at the meeting expressed vocal dissatisfaction with the vote. Mrs. Rutherford proceeded to “chastise and scold the voters for not understanding what a “tough job” it is being up here and having to make these tough decisions.

Well guess what Judi…I have three comments:

1). You should have known what you were getting into before you choose to run for political office.
2). Not to worry about the pressure, because will do our best to vote you off the Council next chance we get!
3). If you can’t stand the heat …get out of the kitchen.

Judi-ann had no business to scold the people in attendance for voicing dissatisfaction with the vote. What was interesting about this display is that no one from the general public in attendance directed his or her dissatisfaction directly at Mrs. Rutherford. However, she seemed so stressed…that she lashed out at the public (the voters). She was so upset her face was red and she removed her glasses…great body language Judi-ann!

Bottom line Judi-ann is that you owe those voters in attendance at the meeting last night an apology for your rudeness. A public official has to learn how to take criticism. If you can’t (which was well displayed last evening)…you need to resign from office immediately.

First of all Steve Brown/skyspy/spearroadguy are all the same person or at the very least all suffering from the same mental defect or defects.

Yes, Judi was rude. She knows that and will apoligize at the next meeting. Being a Yankee in this enviornment is very stressful.
Yankees don't srew around, they listen and make a quick decision and do not suffer fools at all. You all need to get over it. She will be fine.

As far as the actual issue -TDK - get over it. It is a done deal. Move on to something else.

She’ll apologize…sure then is she going to announce that she’s checking into rehab…that is the usual M.O. of a shamed politician that has been exposed.

Can you believe the best excuse you can find to defend her outburst is that “she’s a YANKEE”? As a YANKEE of 30+ years I take personal offense to such a silly excuse.

Could this be defined as “profiling”? Are you suggesting that Yankees are hot headed, shot from the hip, rude and arrogant (all of which Judi-ann demonstrated)?

In all due respect mudcat, I'm a Yankee as well. I also have held and currently hold offices of responsibilities where I have people that I represent. Some don't agree with me and are very vocal. I have never once raised my Yankee voice or lost my cool. Judi-ann. had no business and there is no “YANKEE” or any other excuse for her actions.
As an elected public official you must realize that not everyone will agree with you all the time…it comes with the territory.

I’m curious as to what you know that makes you be so bold as to tell us that she will apologize at the next meeting…hummmmm….you sound as if you may be very close to the situation.

TDK is a done deal...again...sure sounds to me like you are very close to the issue...does anyone know the real mud cat?

Another Taggard apology. Another Father oooops apology---no it didn't happen.
It sure is hard to be a fundamentalist when one doesn't need to swear off anything forever, just do it then apologize, over and over. I couldn't admit to being that ignorant or weak.

Sounds about the same as "mission accomplished," stay the course," to me. Done deal! Why do you say that? What will you get out of it? Have any friends who will get anything out of it? Think a minute: picture that traffic hitting 74 every day!
There has to be some money here for someone or we would cut this thing off right now. Build the d... thing, but take the traffic through their own county.

Friends? Don't know. Some may get something out of it. Don't know and don't care. Why do you?

"Take the traffic through their own county" ???? You must mean Coweta and believe me - traffic over there will be serious. Their roads are not ready for this - at all! So what if some come over here and use our cart paths and date our daughters and shop at our stores? Is that all bad???

By the way, Mission accomplished and Stay the course is Washington DC - not PTC. Don't get all confused about that.
