HIV-infected man gets jail for reckless conduct

A Fayetteville man will serve two years in prison after pleading guilty to one felony count of reckless conduct for having sex with another man without disclosing his HIV positive status.

Garry Wayne Carriker II, 26, of 205 Pine Trail Road, was sentenced the prison term and another eight years probation by Fayette Superior Court Judge Johnnie L. Caldwell Jr.

According to court documents, the incident occurred between Dec. 12, 2003, and April 30, 2004.

Assistant District Attorney Al Dixon said the victim in the case agreed to the plea proposal.

HIV, short for human immunodeficiency virus, is the virus that can cause AIDS in some people, according to the Centers for Disease Control.

Carriker has also been charged for similar cases involving two other victims in Atlanta. A civil suit has also been filed against him, seeking damages.

The victim in the case, John Withrow of Peachtree City, has filed a civil suit against Carriker, alleging that Carriker said he was HIV negative. Carriker filed a response to the suit, saying he disclosed his HIV positive status to Withrow.

Withrow’s suit claims that Carriker revealed his was infected with HIV after the couple broke up. Withrow is seeking general damages, money to cover any medical treatment he might receive, pain and suffering and punitive damages.

A 1997 graduate of Fayette County High School, Carriker was a fourth-year medical student at Emory University at the time of his arrest.
