The Peachtree City Council voted unanimously to allow a previously approved annexation to be reconsidered even though the landowner is not proposing any changes to the approved plans.

Brent Scarbrough and Company wants the process re-done to resolve a lawsuit that was filed by a citizen which challenged the annexations on a technicality, according to a company representative.

Scarbrough is not proposing any changes to the zoning which allows 650 homes on 400 acres in a subdivision that would be restricted to residents 55 and older. The tract is located on the west side of Ga. Highway 74 north near Old Senoia Road.

The lawsuit, filed by Peachtree City resident David Worley, also challenges the rezoning for John Wieland Homes that was approved for a 380-tract of land to the south, and a Wieland official told council his company planned on taking the same action.

The lawsuit has lingered unresolved and has not been assigned a judge in part because of state budget cuts on senior judges, the Scarbrough representative reported.

The minimum house size proposed by Scarbrough is 1,500 square feet and 120 acres of lakes floodplain, streams and buffers will remain undeveloped.

Scarbrough and Wieland have committed to building a 1.5 mile extension of MacDuff Parkway that will link it with Ga. Highway 74 north via Old Senoia Road.
