Girl, 12, testifies step-dad molested her

A 12-year-old girl described sordid details of her then-stepfather molesting her on numerous occasions to a Fayette County jury Tuesday morning.

The victim testified that Robert Wayne Fogerty, 45, of Newnan once told her that she “shouldn’t feel guilty” about the sexual encounters because “I’m trying to teach you for when you get older.” She said Fogerty also told her he was molested when he was a child.

The victim, whose name is being withheld because of her age, said the incidents of molestation would take place three or four times a week, and she provided explicit details of the contact that she said was initiated by Fogerty. On several occasions, Fogerty would try and kiss her but she managed to get away, the victim said.

On other occasions, however, Fogerty touched and rubbed her genitals and asked her to perform oral sex, which she did, though she testified that she later regretted it. The victim also graphically described various other sexual acts that occurred between her and Fogerty.

The victim testified that the incidents took place either in Fogerty’s office inside the family’s Peachtree City home or in her mother’s bedroom. On some of the occasions the victim said Fogerty was viewing porn, either on the computer or on a television when she went to see him, sometimes seeking help with her homework.

The victim teared up briefly during parts of her testimony but mostly answered questions in a matter-of-fact manner. When speaking to District Attorney Scott Ballard, the victim blocked her view of Fogerty with her hand held up to her face. She also rearranged her hair to block Fogerty from her view.

The victim pointed in Fogerty’s direction when he asked her to identify the man she referred to as “Bob.”

Fogerty is on trial for one count of aggravated child molestation and three counts of child molestation.

The victim testified about how she first told her mother about the incidents just before her mother was leaving the family’s home for a party. She said her mom told her they would talk about it later and then left for the party.

Afterward the victim said her mother took her to see a therapist who suggested that she and her mom confront Fogerty. During the confrontation at the family’s home, the victim said Fogerty and her mother asked questions of her, such as, “If you want Bob out of the house, why didn’t you just say so?”

The victim said she didn’t initially report the incidents because she wanted to give Fogerty several chances to stop. She also noted that Fogerty made her mom very happy.
