Delay requested for Oakley development

Delay requested. Delay approved. The Fulton County Board of Commissioners (BOC) Sept. 5 approved a request by Carmichael Development, LLC and another by builder D. R. Horton to delay requests on development proposals on Oakley Industrial Boulevard just west of Ga. Highway 138. The proposals were recently denied by the county’s Community Zoning Board (CZB).

Carmichael requested a 60-day delay for consideration of a proposed residential development that includes 240 apartment units, 159 senior living units and 66 townhomes to be located on 33.729 acres along the north side of Oakley Industrial and east of Oakley Road. The current zoning is M-1 (Light Industrial) and is proposed to change to A-L (Apartment Limited) with a use permit for senior housing. Such zoning accommodates 13.79 units per acre. Carmichael also requested a variance on the senior housing portion from 223 parking spaces to 139 spaces.

Horton, developer of Oakley Township subdivision, requested a 30-day delay for consideration of a request to rezone 7.341 acres adjacent to the subdivision for retail use. Located on the south side of Oakley Industrial, the area is zoned M-1 and CUP (Community Unit Plan), Horton requested C-1 (Community Business) zoning. The acreage is proposed for 17,400 square feet of retail and 8,600 square feet of restaurant space.

Both proposals were denied by CZB at the Aug. 21 meeting after hearing opposition from Oakley Township residents who attended the meeting. CZB commissioner Sandra Hardy commented on the vote to delay, expressing concerns over the BOC’s actions.

“As a CZB member and the creator of the South Fulton Community Improvement District I am confused why the BOC granted a delay after so many in the Oakley Township community expressed so many concerns about these developments,” Hardy said Thursday. “The board of commissioners is jeopardizing the current and future residents of the Oakley area and the proposed City of South Fulton. Traffic is already horrendous and anything but a denial is not in the best interest of the community, the current industrial businesses or the Fulton County Land Use Plan.”

The vote for the City of South Fulton will be held Sept. 18.
