PTC limits rezoning to 4 lots, not 6

A 4-acre tract of land off Peachtree Parkway was rezoned by the City Council last week, although not at the density requested by the applicant.

The lot is adjacent to St. Andrews-in-the-Pines Episcopal Church but will be accessed from a driveway off the parkway. Mr. and Mrs. Victor Daniel had sought to rezone the property from R-43, which requires a minimum lot size of one acre, to general residential.

The Daniels hoped to gain approval for a six-lot subdivision. Instead, they were restricted by council to no more than four lots, with an R-22 zoning which allows for smaller lot sizes and is similar to other properties in the area. But council also required the development to meet all the other R-43 standards such as setbacks and the like.

City staff had recommended denying the rezoning to general residential, indicating that it would basically create a “spot zoning” situation.

Council in fact voted unanimously to deny the rezoning request for general residential, and immediately afterward the Daniels’ attorney, former City Councilman Murray Weed, asked if council would approve the R-22 zoning.

Weed pointed out that the Daniels agreed to abide by the planning commission’s wishes to get rid of the proposed gate for the property.

The site plan must be reconsidered by the planning commission before the Daniels can proceed, council ruled.
