Re: Congressman Westmoreland

Dear Mr. Passantino, this is in response to your faxed letter received Friday, Sept. 29, referencing a posting made by some unknown person to a blog on the Web site of our client, The Citizen.

Shortly after the posting was made public on The Citizen’s Web site, it was removed, presumably by the person posting it and certainly by someone unknown to the newspaper.

On behalf of my client, let me state that the posting did not constitute any defamatory statement, libel or slander, to Congressman Westmoreland or any other person. If read closely, you will see that it is not understandable as to what the person is attempting to state. The posting is certainly not defamatory to Congressman Westmoreland under these or any other circumstances.

We do take exception to the fact that an employee of Congressman Westmoreland called the client’s publisher and made threats that the newspaper would be hearing from Congressman Westmoreland’s lawyer. It is presumed that your letter is following through on this threat.

It appears that the matter has resolved itself and is no longer an issue. However, I did want to respond to you as soon as possible and point out that the newspaper has in the past and will in the future ardently defend spurious allegations of libel.
