New zoning resolution passed

Fulton County Commissioners approved an eight-part amendment to the Fulton County Zoning Resolution during the board’s regular meeting earlier this week.

The resolution adds a definition of group residences for children.  Residences for children under the age of 17 may apply for a use permit rather than rezoning.  However, any home with more than eight children will be required to apply for rezoning.  All use permits must be approved by the Board of Commissioners. The amendment also specifies that a children’s group residence may not serve as an alternative to incarceration.

The amendment also places time restrictions on temporary structures such as tents, site-built, mobile or manufactured structures and on temporary classroom facilities. The administrative permits for temporary structures or temporary classrooms will expire three years from the date of approval, at which time the structure must be removed unless a new permit is obtained within 30 days of the expiration date.

Other provisions within the amendment include:

• A requirement for landscaping around on-site storm water detention facilities,

• Recognition of older lots created between 1955 and 1967 as legal non-conforming lots,

• Requirements for a minimum setback for fences and walls from rights-of-way,

• The elimination of the use of real estate signs in the Northwest Overlay District, and

• A stipulation that allows the Board of Commissioners more latitude in reviewing and approving concurrent variances on single family subdivisions.
