Man in indecent photo convicted for exploiting child

A Fayetteville man who had his picture taken with a 15-year-old girl in partial undress was convicted by a jury Thursday.

Davon Lamall Berry, 23, was found guilty of one felony count of sexually exploiting a child. He will be sentenced Monday by presiding Superior Court Judge Johnnie L. Caldwell Jr.

The victim, a Tyrone girl who at the time went to Sandy Creek High School, did not testify in the case.

Tyrone police Det. Dean Johnson testified that the girl did not tell him who Berry was when the criminal investigation opened. Instead, he learned Berry’s identity from Det. Ethan Harper at the Fayette County Sheriff’s Department.

The photograph was found by a family member at the victim’s home, prompting the police report.

According to the indictment, Berry used, induced or enticed the girl into taking the picture with him.
