Tyrone to fight Callaway judgment

The legal maneuvering between the town of Tyrone and developer John Callaway will continue.

Last week, Fayette Superior Court Judge Johnnie Caldwell ordered the town to put 74 acres at Ga. Highway 74 and Tyrone Road into an unrestricted commercial zoning district, to allow Callaway to build a shopping center to be possibly anchored by a Publix grocery store.

But after last week's council meeting, the town released a statement saying it will appeal the decision.

In deciding to appeal, the town's leaders issued a press release and said the matter should be decided locally.

"The action for appeal was not only based upon advice of legal counsel, but on the fact that the citizens of Tyrone, as represented by the mayor and Town Council, must have the right and privilege to determine the fate of Tyrone," the statement read.

The statement is also clear on the town's feelings for what will happen if the appeal is lost.

"Should this ruling be allowed to stand, it will destroy the integrity of the planning effort by the citizens of Tyrone, the Planning Commission and the Town Council to preserve the character and uniqueness of Tyrone."

It is not known when the town's appeal will be heard.
