President Obama's expressed hope today in his weekly address "that we can avoid the political posturing and ideological brinksmanship that has bogged down this (Supreme Court nomination) process, and Congress, in the past" runs against another historical first for the 44th president: his unique role in history as the first US President to have ever voted to filibuster a Supreme Court nominee.

The Republicans invented the filibuster against Supreme Court nominees in 1963. They won then. This time they are irrelevant.

JeffC correct on history--- LBJ was the first President to face a filibuster of a SCt nominee. Some have attempted to label Rutherford B. Hayes as the first, but the cloture rule did not exist. JeffC is right-- this is the process and his history is correct. I would concur.

However, I would agree with Fred Garvin as well. President Obama is being intellectually dishonest with America. He proposes a statesmen-like review of Supreme Court nominations in a very lofty manner, revealing his target fixation on his legacy. The fact is that his very short Senate service included a bareknuckled filibuster and the rules of the Senate allow for that. It is a good process. But don't now stand in the Rose Garden espousing a higher, more noble standard when you were just months before down in the mud wrestling with the pigs.

The filibuster is allowed. It is good. Senate review of nominees by the President is a vital and precious check provided for under the Constitution. BTW--- I agree on the Bork comments. When Bork was willing to fire Archibald Cox as Nixon demanded (after statesman Elliott Richardson refused) Bork disqualified himself for office.

I didn't notice your complaints when Bush added $5 trillion in debt or took over AIG and Citigroup or the Goldman Sachs bailout or the Bear Stearns bailout or expanded the wiretaps without judicial review or the “sneak and peek” searches without a warrant showing probable cause or Ashcroft's authorizing the monitoring of attorney-client conversations or the suspension of Habeas Corpus or ......

Back to normal. I feel better.
