Tracking Taxpayers’ Money in TyroneNow that Tyrone’s proposed 2008-2009 budget is on the web along with the 2007-2008 adopted budget, anyone with common sense or business experience can pin down the $43,103 paid to employees Barry Amos & Valerie Fowler in 2007. The Facts: 1. Barry’s 2007 salary was $93,404. He received total compensation for $113,622. The difference of $20,219 is the figure we need to break down. 2. Valerie’s 2007 salary was $64,499. She received $87,383 salary. The difference is $22,884 to break down. 3. The total paid to both employees above their salary was $43,103. 4. Issue: For what purpose was this money paid? 5. It wasn’t paid for accrued annual/vacation benefits as Valerie said, because the pay plan only allows accrued leave to be paid upon resignation or termination. 6. At the time Valerie authorized checks in November 2007; she & Barry were both still employed. 7. Over-time/comp pay for administrative personnel is paid at the daily salary rate. 8. Valerie’s daily salary rate is $248.00 or $31.00 per hour. 9. Barry’s daily salary rate is $359.00 or $44.90 per hour. 10. An administrative employee may only accrue a maximum of 80 hours of overtime/compensatory time. 11. For Valerie the maximum overtime/comp time would be 80 hours x $31.00 per hour equals $2,480 maximum. 12. Valerie paid herself $22,884 less $2,480 allowed equals $20,404 over payment. 13. Barry maximum overtime/comp time would be 80 hours x $44.90 per hour equals $3,592. 14. Barry was over paid $20,219 less $3,592 equals $16,627 maximum. 15. Neither Barry nor Valerie had accrued 80 overtime hours. Conclusion: Barry and Valerie paid themselves more than $37,000 not allowed of taxpayers money. The exact amount can be calculated by examining the required bi-weekly hours turned in on time sheets. Town Officials have said that the Town lawyer was instructed to look into the legality of these overpayments. Don’t hold your breath on this. What are the possible legalities? 1. Mistake - If you’re on jury are you going to buy this excuse from a 20 year employee in charge of issuing checks and keeping records? 2. Conspiracy to defraud a government - Theft of government property which is under the control of an employee or official in his or her official capacity. 1-5 years in prison. O.C.G.A.§16-10-21. 3. Theft by conversion - a government official or employee who takes public funds for his own use in violation of legal obligations or breach of duties. If more than $500 it’s a felony. 1-15 years in prison. O.C.G.A. § 16-18-12. 4. Abuse of governmental office - Termination of a government official does not relieve the party from prosecution.
