A child over 14 years of age can choose which parent will have custody upon the consent of the court. The court considers it important for a child to maintain a relationship with both parents; therefore, visitation rights are awarded to the parent who is not given legal custody of the child.

However, your husband will still be responsible for paying you child support until and unless a custody change is filed stating he is now the custodial parent.

Any change in custody MUST BE HANDLED THROUGH THE COURTS to legally change the existing court order. Otherwise, all is still in place and he would be guilty of interference with child custody. You would have to be served and sign any change(s) in the court order.

You will be responsible, if there is a change in custody, for child support until the child dies, becomes 20 years of age, graduates, or is emancipated.

Since your husband is in Alabama, you may want to check and see if he filed something there. The change in custody though, to be recognized in Georgia, would have to occur where you and the child (your son) currently reside.
