A single bench trial set for today makes up the entire week's schedule for Superior Court in Fayette County. Ahmad Rashad Philpotts faces a felony charge of robbery after being arrested by Fayetteville police April 14 of last year. Philpotts allegedly snatched a purse in the Wal-Mart parking lot. The case will be heard in Judge Paschal English's courtroom, with assistant district attorney Tom Woodward handling the prosecution. Two other recently filed cases have been removed from the Superior Court criminal docket. Jerry Levaughn Johnson, charged with theft by receiving, saw his case dismissed April 14. His remaining charges, marijuana possession and two traffic violations, have been transferred to State Court. A warrant had been taken out for Buster Petaway on the charge of theft by receiving. That warrant was dismissed April 16. In State Court this week, the final case of the current two-week criminal session begins today with the jury trial of Joseph Giovinco, who is charged with contributing to the unruliness of a minor. A jury late Tuesday afternoon found Kenneth Brewton guilty of possession of marijuana. He was arrested by the Fayette County Sheriff's Department Dec. 18 near the intersection of Neely and Longview roads, behind a concrete plant on Ga. Highway 314. Brewton was sentenced to 12 months probation, a $1,000 fine plus court costs, and he was given first-offender status. A warrant was issued for Joseph Corley, who did not show up in court Monday to face charges of theft by taking and theft by receiving stolen property. The case of Brian Scott Tilton, who was charged with simple battery, was placed on the dead docket Monday due to insufficient evidence. He paid court costs.
