Commission: home business should conform to intent of law

The Coweta County Commission will take hard look at home based businesses after a lengthy discussion Tuesday afternoon.

The commission granted two conditional use business certificates to William Overby and Stanley Brown, but said they wanted a staff written report on the county's home business ordinance before they discussed any more requests.

"We're zoning commercial in a residential zoning," said Commissioner Vernon "Mutt" Hunter.

While Hunter said his concerns were not about the two issues before the board, he said the board needed to give further study to the whole issue. The recommendation of granting the conditional use certificates came from the Tax Review and Appeals Board and Hunter is not happy with the current setup.

"We have a quasi-governmental board doing zoning," he said.

Hunter's main concern is that too many businesses in the county are claiming to be small, home based businesses, but they're actually employing eight to 10 people. The commissioners had asked staff to look at the issue several months ago. Hunter said a resolution to the problem is needed soon, since the situation has "gone wild."

The other commissioners agreed with Hunter, but said the cases before the board were not in violation of the ordinance. William Overby wants to open a small tractor repair business behind his home on Ridley Road in Palmetto.

"Nobody can see his business and he's just going to do the repair to have something to do," said Chairman Jim McGuffey.

Brown was seeking an additional business use certificate for his auto repair business on Poplar Road that he has operated for several years.

County Administrator Theron Gay told the commission he would have a report outlining the county's home business ordinance by the first meeting in November.
