Bad Links? | Planning Comm. revisits Valleywood Rd. rezoningBy LEE WILLIAMS With an applicants lawsuit and letter of support from a former opponent in hand, Tyrone Planning Commission revisited a request to rezone 26.1 acres of old farm land on Valleywood Road to make way for a 19-home subdivision. Ann Williams of 139 Valleywood Rd. and her attorney H. Geoffrey Slade Sr. of Fayetteville presented a letter of support from Paul S. Liston, a former opponent and adjacent property owner, and asked the commission to approve the rezoning of the tract from AR or agricultural to R-48 or minimum one-acre lots. Town Manager Barry Amos said staff agreed the proposal was consistent with the land use map. But still, changes would have to be made, he indicated. Valleywood is a dirt road and does not meet the towns standards, Amos said. It would have to be upgraded to meet towns standards. The 90 degrees curve would have to be realigned on the southeast end of the property. The commission unanimously approved the proposal 3-0, with the condition that road improvements are made on Valleywood Road to town standards. Williams filed a lawsuit on Feb. 18 after her proposal was voted down by the commission and later by the Tyrone Town Council on Jan. 20. Williams said Thursday that she wanted to sell the old farm land and move with her daughter in Kennesaw. She said the land as currently zoned is no longer profitable since farm land is not in demand in Tyrone. According to the lawsuit, the property is worth $293,540 zoned agricultural. It would be worth $684,864 if the rezoning is be approved. Williams cleared the first hurdle during the commission meeting held at 7 p.m. Thursday at Town Hall. But her lawyer, Slade, could not say if his client planned to drop the lawsuit after Thursdays vote. Slade said he would wait until the Town Council, which has the final say, addresses the issue later this month. We will make our decision after the July 21 meeting, Slade said. |
