Bad Links? | Tyrone sued over denial of rezoning applicationBy JOHN MUNFORD A Tyrone woman is suing the town for denying a request to rezone her 26.1 acre tract for a 19-home subdivision. In January, Town Council denied the rezoning for Ann Williams property despite the project being consistent with the towns land use plan. According to minutes of the meeting, city staff expressed concerns about the partially-paved Valleywood Road which would serve the subdivision. One of the persons objecting to the rezoning was Paul Liston, who owns a horse farm adjacent to the property. According to minutes of the meeting, Liston complained the road is not safe and speeding vehicles have crashed through his fence, allowing the horses to run loose. Mrs. Williams real estate agent noted that Liston had previously offered to buy the property, which Liston confirmed was contingent upon R-48 zoning. But Liston told council he had no intentions to develop the property, the minutes stated. The property is zoned agriculture-residential and Williams wants R-48 zoning, which allows one-acre lot sizes. Williams told council she wants to sell the property, which includes her home, so she can move closer to her daughter since she can no longer maintain the house. In the lawsuit, Williams claims the traffic concerns about Valleywood Road were just an excuse for the rezoning to be denied.
