A Clayton County policeman was arrested this week on a felony charge for going over the top while striking his son with a belt at their Fayetteville home, police said.

Derek Presley, 33, was charged with one felony count of cruelty to children in the first degree. According to the warrant for his arrest, he “maliciously” hurt his 10-year-old son by striking him in the buttocks and legs with the belt.

Presley, who serves in the traffic division of the Clayton County Police Department, has been put on paid administrative leave, said Police Chief Darrell Partain. Partain said he would make a decision on Presley’s status next week after meeting with him and Fayette County authorities who are conducting the investigation.

The Clayton County Police Department is cooperating fully with Fayette County officials working the case, Partain noted.

“Some things in law enforcement are not very pleasurable,” Partain said, adding that he would not comment directly on the investigation itself.

Partain said Presley has been an asset to the traffic unit and hasn’t caused any problems.

A $5,000 bond was granted to Presley, with conditions that he not physically abuse, threaten or argue with the victim if he regains custody. Presley’s children were temporarily in the custody of the Fayette County Department of Family and Children Services, officials said.
