Rezoning approved by Fayetteville to resolve technicality on propertyBy JOHN

The Fayetteville City Council has approved a rezoning initiated by city staff to clear up mistakes on legal descriptions for a 50-acre tract of land across Ga. Highway 54 from Fayette Community Hospital. No new development is proposed for the area, which is the location of the former Emory Clinic building. The property was zoned as two different tracts in 1988, one tract being C-3 highway commercial and the other being R-P residential professional. But mistakes were made on the legal descriptions making it unclear where one tract ends and another begins, according to city staff. The rezoning shrinks the amount of commercially-zoned property to 21.17 acres while increasing the amount of residentially-zoned property to 29.25 acres. That will be more compatible with other residential properties in the area, according to Jahnee Prince, the city's director of planning and zoning. No one spoke in favor of or against the rezoning during Thursday's council meeting. The residential professional zoning classification allows any use permitted in single family residential districts in addition to the other following uses, with some restrictions: Offices providing professional services. Hospitals, medical and dental clinics and doctor's offices. Nursing, convalescent, assisted living and care homes. Day care or kindergarten facilities. Orphanages and care homes. Public and private educational institutions offering general education courses. Art and photography studios and offices of interior decorators.
