City-county dispute going to court

The latest dispute over annexation efforts by Fayetteville has wound up in Fayette Superior Court.

Fayette County is suing Fayetteville Mayor Ken Steele and the City Council over two tracts of land annexed near the Fayette Pavilion shopping center.

The two tracts total nearly 60 acres. A 55-acre tract borders Ga. Highway 314, while the other tract is a five acre site south of the Fayette Pavilion on Ga. Highway 85.

County officials maintain the annexations are creating confusion about which government agency should provide service to the area.

The county maintains the annexations created islands of city property surrounded by unincorporated property.

But in the annexations, Fayetteville officials left a 10-foot strip that connects unincorporated property, so the city maintains the properties are not islands.

Fayetteville officials are maintaining the properties need sewer to be used, which is unavailable in the county.

County officials are seeking a declatory judgement in the case and are hoping for a February hearing in the case.
