Fayette man sues Home Depot for severed finger

A Fayette County man is suing Home Depot for an injury he suffered at the Fayette Pavilion store March 22.

Dieter H. Schmidt claims a unrestrained piece of lumber struck him from above without warning, severing a finger from his right hand.

The suit claims Home Depot was negligent in failing to properly secure lumber in the area where Schmidt was waiting for assistance when he was struck. The store did not use safety restraining devices to secure the lumber, the suit claims.

Schmidt's wife Miriam is also a plaintiff in the suit, as the couple claims the injury and resulting recovery have damaged their marital relationship.

The Schmidts are also seeking unspecified damages for permanent impairment, pain, bodily injury and loss of wages and earning capacity.

Home Depot has not yet responded to the suit, which was filed last week in Fayette County Superior Court.
