Father sues school system over son's beating, suspension at Sandy Creek

A Tyrone man is suing the Fayette County School System for $2.1 million for suspending his son from school after he was assaulted during an altercation and failing to seek medical treatment for him.

In the suit, David Mays claims his son Daniel was the victim of a "violent beating" at Sandy Creek High School Sept. 4 that was captured on a school video camera. Mays also claims that his son did not resist his attackers, and that the video depicts Daniel Mays being kicked in the head numerous times.

David Mays, who is representing himself in the case, also contends the school should have sought a neurological evaluation for his son after the incident. Instead, he was sent home with large contusions on his jaw and head, the suit claims.

The suit also challenges the two-day suspension given to the younger Mays, claiming his prior disciplinary record didn't warrant the action.

SCHS Principal Roy Rabold and Fayette secondary schools director Wayne Robinson were also listed as defendants in the suit.

Schools spokesperson Melinda Berry-Dreisbach declined comment on the suit, citing pending litigation. As part of the legal process, the school system will eventually file a reply to the allegations contained in Mays' complaint.

A lawsuit only represents one side of a dispute.
