A Peachtree City man has been indicted by a Fayette County Grand Jury for raping a 16-year-old girl at the Subway sandwich store off Ga. Highway 54 in February.

Daniel Joseph Venn, 19, of Peachtree City was indicted by the September term of the grand jury for rape, sexual battery and two counts of aggravated sodomy.

Since prosecutors handled the indictment as a special presentment, Venn wasn't arrested until after the grand jury returned the true bill on all four counts.

Dan Hiatt, chief assistant district attorney, declined to explain why prosecutors decided to use the special presentment process instead of having police process a warrant for Venn's arrest.

The incident, which occurred Feb. 4, was investigated by the Peachtree City Police Department. According to the incident report, the victim said that on the evening of the attack, Venn told her he was going to work late "to get overtime."

The victim told police that Venn later approached her from behind and began to kiss her once she went to wash dishes in the back of the store. The incident escalated from there, as he forced himself on her sexually, the victim told police.

The victim told police that after the incident, Venn told her he would call her. When Venn left at her urging, the victim locked the door so he couldn't re-enter the store, the police report stated.
