County wants state to investigate Fayetteville annexation

Fayette County is asking the Department of Community Affairs to examine Fayetteville's latest annexation request.

The city informed the county last week it wants to annex a nearly 55-acre tract at the Fayette Pavilion. The tract is east of Ga. Highway 314 and includes Kohl's, Belk, and the old Dekor building.

Assistant county attorney Dennis Davenport told the County Commission last Thursday the request should be forwarded to the DCA because the city did not ask to annex the entire parcel. The city left a 10-ft. strip near Hwy. 314, which violates the 100 percent rule required by any annexation.

By leaving the strip out, Davenport said the city also leaves an island, which is not allowed in annexation cases.

The attorney recommended the county ask DCA for an administrative ruling on the case before it responds back to the city.

The latest call for annexation by Fayetteville follows a request earlier this year to annex property on the south side of town.
