County may sue to stop Tyrone sewer service bid

Fayette County will probably file for an injunction to stop Tyrone from tapping onto the city of Fairburn's sewer system "soon," according to County Commission Chairman Greg Dunn.

John Wieland Homes' Southampton subdivision, under construction west of downtown Tyrone, already is advertising itself as a sewered community, Dunn said this week.

"We're going to have to do something pretty soon," he said.

County officials object to the town's plans, saying provision of sewer from the Fulton County city violates Fayette's autonomy and might make sewerage available in the unincorporated area of the county, something county leaders have long opposed because of the potential for increased housing and commercial density.

But Tyrone leaders say their plan is to provide sewer service only to the Wieland subdivision and related commercial areas, and to a proposed office development on Ga. Highway 74.

And because the town will extend its own sewer lines to the city limits to tie into the city's system, there's no violation of Fayette's autonomy, town officials say.

The dispute is one of a growing number of disagreements that have erupted over the last two years, ever since Tyrone leaders began pushing for "tax equity," saying town citizens pay more in county taxes than they receive in county services.
