PTC sued over denial of rezoning for restaurant

A local business owner has sued Peachtree City over a rezoning denial which would allow a custom frame shop to become a restaurant. Patricia Wright of P.K. Wright Galleries filed the suit last week in Fayette County Superior Court. She is asking a judge to rule that a rezoning from limited use commercial to general commercial is proper; otherwise she wants the judge to allow the restaurant to operate under the limited use commercial zoning. The Galleries is a custom frame shop located at 399 Ga. Highway 74 North. It also contains several retail areas leased to individuals starting their own arts and crafts businesses. At recent council meetings, Wright said she is selling the business due to her failing health. She also said the restaurant which would operate there would be locally owned. Council recently denied Wright's request for a general commercial rezoning, stating that she was aware if the use of the property changed, its zoning would revert to its previous zoning of office-institutional. In court papers, Wright argues that there are five eating and drinking establishments within two-tenths of a mile of her property. Wright is also seeking monetary damages in the suit. A lawsuit represents one side of an issue. Peachtree City has not yet filed its response to the lawsuit and the allegations contained in it. City officials originally suggested that Wright seek another limited use commercial rezoning, but her time constraints to sell the property kept a special LUC plan from being designed. In the suit, Wright contends the property has been marketed under its current zoning for a year with no offers. But the property has not been marketed as office-institutional, it was revealed at a recent meeting.
