Fayetteville settles lawsuit with Pavilion developer

A special called meeting has been set for tonight for the Fayetteville City Council to approve a settlement agreement of a lawsuit filed by developer Stan Thomas.

Thomas filed suit over the city's reversion of zoning for property near Fayette Pavilion. The developer had planned to put two restaurants on the site, with a road connecting the site to the Pavilion and tieing into Ga. Highway 85 across from Ellis Road.

A condition of zoning for the project was that the road be completed by a certain date, and the city reversed the zoning when that didn't occur. Thomas sued asking that the zoning be restored.

The meeting will take place at 7 p.m. in the council chambers at City Hall, just before the regularly scheduled council workshop, City Clerk Judy Stephens told The Citizen Monday.

City officials said under the settlement, Thomas will be able to develop the restaurant and road as previously planned.
