Murder suspect gets June hearing

After a June arraignment and motion hearing, a fall trial seems likely for the second suspect in last year's murder of an alleged drug dealer found in a burned-out sport utility vehicle.

Glen Simon Hamilton faces 11 felony counts, include malice murder and felony murder, for the April 1 slaying of Adolf Stubbs, whose body was found in north Fayette County.

Karl Hodge is also in custody on the same charges, and authorities are hoping to begin his trial in August. Motion hearings are scheduled for next month.

Fayette County Superior Court Judge Ben Miller said he did not want to set a trial date yet for Hamilton, whose first court appearance was Tuesday.

As with Hodge, District Attorney William McBroom stated that he will seek the death penalty against Hamilton.

Both men were arrested in May after an investigation that stretched from New York, where Stubbs lived, to Florida. It is believed that the victim and both defendants were partners in a drug deal that turned sour. A third suspect is believed to have fled to Jamaica.

Miller asked Moore M.O. Ibekwe, a College Park attorney representing Hamilton, how long he would need to review discovery materials before a motion hearing, and Ibekwe gave an estimate of 60 days, saying that he had just received them that day.

McBroom pointed out that the materials had been available for Ibekwe since January, and he had never bothered to pick them up. “We just served them on him today,” he said.

Miller scheduled a motion hearing for June 7, then suggested an arraignment date of March 10. Ibekwe said he was not comfortable with the March date, so Miller put both hearings on June 7, with arraignment at 9 a.m.
